Landlord selling house and I'm 6 mths pregnant

    Don't worry I wouldn't actually go ahead and do it, it was just a thought, a run on from what GDB2222 said. I am fully aware of the recklessness and stupidity of it. I am going to contemplate all options and discard the worst, that one will be the first to go. I know that pulling fast ones like that never work out in the long or short run and what I don't want to be doing right now is adding more stress

    The reason it won't work is that once the landlord applies to have the rent paid direct because you are 8 weeks in arrears the council will have on record that you are in arrears. So there is the risk that they will class you as having made yourself homeless by not paying your rent and their legal requirement to help you goes out of the window. Also not only could the landlord apply to the council to have the rent paid direct, but he could apply to the courts to evict under section 8 because you are behind with the rent. So then you end up homeless with no help from anyone.

    Is this your first child? I do know someone that refused to leave hospital until the council rehoused them. Turned out they could stay in the maternity ward for upto 28 days before the hospital could force them to leave!

    Exactly, you're right. I am fully aware that in my precarious position any screw up, especially deliberate, will remove the councils responsibility to rehouse me, privately or otherwise

    No it is my second child. I have phoned social services to see if they could help as I was told that the council may put us into a B&B for up to 6 weeks while they assess us once we have been evicted. I explained my concerns that a shared bathroom, one bedroom and no cooking facilities was not suitable living accommodation for a child and a newborn and they said they couldn't help. However, once the baby is born and I am in hospital and nursing, I have been advised that there is a special system whereby social services can get involved and assist as I am then classed as super vulnerable, or something like that. I can't remember the exact wording, but it is something I can put into action if I need to as soon as the baby is born

I have already given my permission for tomorrows viewings to go ahead but the LA is coming a bit earlier than the prospective buyers and I will tell him that both the LL and I are in tricky situations and that as I am not obligated to allow viewings, after tomorrow unless I have been served notice I won't allow anymore unless I am in the final month of my tenant as per the LLs and LAs contract.

    That won't do it. Even in the final month of the contract, if he has not served S21 it just goes into a periodic (monthly) tenancy with no end date, so you will still be no nearer to the councils definition of threatened with homelessness. Just politely advise them that until notice is served, no further viewings will be permitted. But I do think getting hold of the LL direct may be the best option.

    Of course, it is possible that the property gets sold to another LL who would be glad of a ready made tenant. But that is a bit of a long-shot.

    Yes it is. Is it a long shot that the house won't sell? If the house doesn't sell, I don't want to have given the LL an ultimatum and been served an S21 for nothing. But then if it doesn't sell he may decide not to act on it

    Once the notice expires, the landlord is in a strong position with regard to you vacating. However, I'm sure he will also want to maintain the rental income for as long as possible so it would be unlikely (and expensive) for him to act on it, as long as you both understand the mutual benefit of the S21. At the end of the day, in a depressed market, the property may well remain unsold for quite some time (even longer without viewings). And in the mean time, the council have time to assist you without the need for B+B. Everyone's a winner.

  • I agree that you need to tell the landlord your situation. He would have an absolute nightmare if he got an offer on the house and then you refused to move. You could even explain this to the viewers. I would never buy a house for myself if I thought the tenants would be staying! Then you could encourage people buying it with you in it that you are a good tenant. You have a lot of power in some ways.
    Of course it isn't the landlord's problem that you're pregnant but it's not your problem that he wants to sell the house.
    What a rubbish situation though. I hope you can manage to relax and not stress too much :(
