  • That sounds positive though! My hubby would love for things to be amicable with his ex wife again as he hasn't seen his daughter now since August 2009, all over hassle caused by CSA assessment. We just don't have the money to go to solicitors etc to fight it at the moment, and keep hoping and praying she'll wake up one day and feel bad about what she's done. I'm not holding my breath though. That's the one thing my ex can't throw at me, as even though he hasn't handed a single penny over for almost a year, he has still seen his kids every other weekend. I couldn't stop that, it would destroy them.

    I wouldn't let CSA reassessment put you off having the kids more than 52 nights though - after everything you're going through now, why give in to them over something which is such a positive x
    Thats such a shame, its only the children that suffer in the end. My OH hasn't seen his for 2 1/2 years, my little boy doesn't remember his brothers at all!! My OH is seeing his eldest for a couple of hours tomorrow for the first time, and we have all agreed to take things very slowly so overnights are a long way in the future anyway, it was a bit patronising when his ex offered to help us out financially the other day though lol!! I had to be polite and smile through very gritted teeth :D. We will probably just be having them every other weekend from sat/sun eventually, but like I said we are taking things very slowly at the moment!! Hope things get sorted for your OH very soon, I am not sure how some PWC manage to sleep at night tbh xx

    I know, and I say that myself all the time. I don't know how she can do it. I have a feeling she'll start and make noises soon as me and DH are expecting a baby together this summer, and she'll either not want their DD being 'pushed out' (which is a joke after not letting him see her this long!) or she'll just go after him for more money and we still won't see his DD. Sadly, he will never get back that lost time with his DD.

  • Just had a call from CSA with a progress update as promised. They have managed to speak to ex and get income and employment details from him. They are waiting for the evidence (payslips I guess) to arrive and if this hasn't come by Monday they will send the necessary form straight to his employer. They have also asked him to make a card payment on 24th February. If he doesn't make this payment, they are going straight for a DEO. The change of circumstance paperwork is almost complete (just need proof of earnings before finalising reassessment) and will be out to me asap.

    I'm not holding my breath that he will make the card payment, so I know I'll still have some waiting to do. I think I would prefer it to be DEO rather than rely on him making the payments anyway - he's avoided maintenance for a whole year now, I can't see he's suddenly developed a guilty conscience!

    But at least there is some progress :D

  • Another update call .... the evidence they requested from ex never arrived (surprise surprise) :p

    The form was therefore sent out to the employer, and it has come back to say the firm he works for doesn't actually employ him. I guess this is due to him getting the job through an agency? The lady has made several phone calls and has been sent round in circles now trying to sort it, and I could sense her frustration.

    She said that she is now fairly sure of where to seek the information from but if that returns nothing they will have to look at sending someone out to find the information in person, or think of another way to find out. Does anyone have any experience of this and what it means?

    Why couldn't he just give them what they asked for just for once?!! :mad:

    I was told something similar although I didn't really understand what they ment.

    When they cannot get hold of the NRP, they will actually visit the address they hold or the employer, regardless if he/she lives and works there or not.

    I think the NRP gets so many chances before they actually do the visit. In my case, I was asked about the NRP where abouts, although I had given them the employers details. They still didn't act on that and wanted his address and contact number, which I did not have.

    Can't believe what has gone on with your case, bit like mine, one minute hopefull, next minute a not. Once my MP has sorted things out with my son's school, I am going to ask for her help with the CSA. I am due to start getting my son's payments some time this month lol but they said that last year.

    What evidence did they request from him? Can you get this information they need? You need to ask the CSA case handler some questions. Sometimes you may not get answers due to data protection act. If the employer doesn't employ him and he is working through the agency, does he actually still work for that employer? If he does, then the CSA need to go to the agency as it will be them paying him.

    They asked him for payslips as I understand. I have supplied them every step of the way with all his details, including changes of address and employer as he hasn't complied since day 1. He definitely works for that employer as my children's god father works there on the opposite shift, which is how I found out he was working there. His wife gives me an update each week on whether he is still there or not. I told the lady today which agency he got the job through (I found out via facebook) and she just said she couldn't tell me whether that was something she had been told, but could take the information from me. She then said she was now fairly sure where to get the info from and would be back in touch. I think I probably confirmed the name of the agency with her own information source. She said that the employer had been very quick giving the information back regards his employment status, so hopefully the agency will be just as quick.

    Luckily I have all the information ... I even remembered his NI number from years of completing forms etc (my memory is just good like that). It's a good job, because he just would never have willingly given them any info. He wouldn't tell me at first where he was living when he moved so I couldn't pass it on, but I got around that by saying 'no address, no children overnight!' as he had just taken me to a solicitor accusing me of stopping contact (which I never have done once, it was just out of spite to cost me money whilst he got his on legal aid :mad:) and the solicitor made it clear he could only have contact if he divulged his address ;). Once reminded of this, he swiftly provided the address and said he had 'forgotten he had moved' :rotfl:. I hope they do send someone round to him - that might actually frighten him into action!

    I'm told he had to make payment next Friday or face DEO. I'm not expecting the money and would probably prefer DEO to be honest. At least there is some legal compulsion then for it to be taken from him rather than expect it to be volunteered, and he will legally have to tell them when he leaves his job etc.

    I just don't know how people have the energy to fight this for several years - several months has been enough for me! At least the CSA are acting now though (after the prod from the MP) - and my caseworker in the complaints team is clearly seeing for herself first hand how totally non-compliant he is being.

  • Just a quick update on our case, my OH had his confirmation letter from CSA on thursday, telling us they had completed his reassessment and he has to pay £53 a week, backdated from 12th July 2010, a bit of a difference from the £98 a week we've been paying since last July lol!! (we are not complaining!!). We are still waiting for the breakdown letter and payment schedule but OH has spoken to CSA on the phine and they have agreed he can reduce his payments immediately. OH has spoken to his ex about the letter and the reduced payments and she seemed fine about it and we have agreed that because the payments have been lowered we are happy to have his boys from fri-sun every other weekend, as the money is not as much of an issue now!! So all looking good, looks as though 2011 will be a good years for us, lower payments, so life will be less of a struggle and we can treat all the children more and my OH is finally having contact with his boys again after not seeing them for over 2 yrs!! I have also calculated that CSA will probably owe us about £650 in overpayments and when and if we ever receive this we are planning to put a deposit down on a holiday abroad for ALL of us (OH, me and all SIX of the children lol), so things r finally looking up for us, sometimes there is a happy ending lol. :D:beer::j
