expensive jeans have worn into a hole in 10 months- where do I stand?

I bought a pair of diesel jeans for £140 from House fo Fraser, Westfields in March 2010 and they have worn to hole at the knee already. I tried to take them back to my local House of Fraser today with a bank statement for the exact amount paid as I only bought the one item in that transaction. Whilst I had proof of purchase, the manager told me that she would expect to see wear and tear after that length of time and it was usual from a pair of jeans that had been 'lightened' and they refused to refund me. Lightened I guess is the process that the jeans have gone through to obtain their appearance.
I spent a lot of money and bought a decent pair of jeans so they would last and I'm really disapointed. What are my rights and do I have any chance of getting my money back? or should I just forget it and buy a cheaper pair and accept that jeans are just not made to last...

You don't have any rights for wear & tear if i is indeed wear & tear and not a manufacturing fault.
If it was a manufacturing fault, it would normally show up sooner.
I suspect that you've paid a high price for a fashionable item or a brand label and not for a durable item.
I think you'd be on dodgy ground after 10 months with clothing.
It would be down to you to prove it's a fault as it's more than 6 months.0 -
I think the assistant and lisyloo are correct you have paid a premium price for a fashional designer item not for a durable one. Money would have been better spent on 2 or 3 pairs of levi's or Gap jeans or the like. 10 months wear is probably fair for what you bought if it was more than occasional use. If you have a problem in future then go back as soon as it starts to develop.
Before 6 months the onus is on them to prove it's not a defect rather than the other way round.
Always difficult with clothing but your more likely to get a better outcome if you take it in as soon as there is a problem.0 -

I think as others said you probably wont get very far if it happened after 3 months possible 6 maybe you would, its a shame because lots of clothes you get are shoddy and you pay a lot you expect lots of useThank you to you both.

you should keep them until jeans with ripped knees come back into fashion , about 5 or 6 years i reckonmy favourite food is spare ribs0

I've given up on branded jeans, they just fall apart on me (modesty prohibits saying exactly where). I suspect the same is true of many 'fashion' brands.
Tesco Value seem to last about a year, for £3 that's acceptable.A kind word lasts a minute, a skelped erse is sair for a day.0 -
In this case you can visit the consumer protection forum with your jeans bill and file a case against them, if you want a return.0

I have to say that Debenhams do "designer" jeans which fit my odd shape nicely and I don't think they are much over £30 a pair... sure some probably are but the ones I've bought haven't been
I could buy £3 tesco jeans - unfortunately they really really do not suit my shape and I look like a tramp in them so I'll pay the premium and buy £30 ones 
If the material feels thin though - be it cheap or because it's been "treated" to look worn then it's life expectancy would be a lot less than a good thick pair of non-bleached/weathered Levi's say...

10 months is a long time. They don't know what you might have been up to while wearing your jeans in the last 10 months.
Isn't it trendy to have holes in jeans nowadays anyway
