Do I have the right to cancel the contract with O2?

Happy new year all,

In October I upgraded to a new Nokia N8 with a new 24 months contract, £15 a month. I was told the tariff was 100min + Unlimited text + 500MB internet data. (The deal was done through the retention as I wanted to leave O2).

But today I found O2 is actually charging me £25 pounds a month, of which £15 is for 100min + Unlimited text, £10 is for the 500MB internet data. I called CS many times today trying to correct the charging, but nobody would help. They insisted the £15 per month tariff doesn't include any data, which is simply not what's agreed on the upgrade.

From my order history, it clearly says:

Order date: 22nd October 2010
Order number: xxxxxxxx
Description: HAN NOK N8 1NON8XXN PM SKU,Online 15 24 Month - for offline,500MB UK Data for Smartphone, ACC O2 Universal cradle ADEUGNRN SKU, Next Day Delivery
Status: Complete

I really feel being fooled by O2. I actually ended up with a very expensive deal - more expensive than the standard deal on the web site (less minutes, higher price for the phone).

Can anybody please advise me if I have a stand to cancel the contract because of this? (They clearly refused to correct it.)

Many thanks in advance.

Not sure if cancellations are allowed on upgrades, never spotted a retention deal that does not have the under lay of 'we think you are a mug'. :o

So your trying to say you haven't checked a bank statement or an account balance since october.

I think the OP has , as they say they have contacted CS on more than one occasion, looking at the order, it looks sort of correct, the handset and voice text tariff, then the other section is the smartphone bolt on (which is chargeable) :o
  • You guys also stay so late :)

DUTR: You are right, although when I called for the PAC I did mean it as I already had a business line with T-mobile and T-mobile did have a very good deal at that time. I was "retended" with a "better" offer. The guy actually told me he would have to add a bolt-on to trick the system as it's a "special offer" "only for me" and "not available to anybody else" and the bolt-on "will be removed after the first bill". Now I do think I am a fool :(

    pcombo: Thanks. Order number removed.

TBH I went to O2 from Orange , was with Orange for nearly 14yrs and their retention offer was no better than if I walked along the high st looking for a deal, in fact it was worse! Plus the 18 month contract did them no favours, I have been happy with O2 and they have resolved all issues for me in a timely manner, saying that I am on a sim only deal now and just buy the handset outright
  • They used to be good before. But recently they obviously changed the way they deal with their customers. On their forum there's another guy with the similar problem with them Quote from the guy "but they are saying that my tariff doesn't come with the 750mb allowance but its stated on my contract so they asked for me to fax it over and called them back and they said i see you have got the 750mb allowance part of your tariff but you shouldn't of been offered this deal"

Like this guy, when I called them they also played with similar lie and bully tactics. They seem to be a quite different team compared with just 2 years ago.

Personally then I would raise a formal complaint, then after 1 month raise the complaint via ofcom if the issue is not resolved in your favour. I would never entertain a mobile contract for more than 12 months :o
