Harsh as it is, from their point of view you spent their money without asking.

I'm sorry but this is factually incorrect.

Their point of view was established during the bank charges test case by their counsel:

''My Lord, it has to be realised, and the OFT acknowledges this in its skeleton, that "unauthorised" is a misnomer. It is a widely or was a widely-used misnomer, but it is simply a misnomer and I want to explain why. Any unauthorised overdraft is in fact authorised by the bank, obviously. And the accurate title for an unauthorised overdraft is "unarranged" or "not prearranged", and it is not materially different from a prearranged overdraft.''

It wouldn't be much of a bank if you were able to simply have ''spent their money without asking''.
  • I understand your frustration.

I assume you haven't tried appealing to them yet? If not, I'd give them a call, stating the facts as you have here and that you're aware of the reasons for the charges. In the end, you do have the option of telling your bank that you'll close your accounts with them.

RBS give you until 14.30 to pay clear funds into your account to avoid any charges.

You can also now register for act now alerts:

Well I was in the bank at 9.30am the follwing day and paid the money back in, and asked about charges, and the cashier said I would still be charged. Sure enough, they did charge me.

This only happened to me last month. Might be worth me speaking to them about this then, as they will surely have a record of when I paid the shortfall back in - well before 14.30pm.

It's close of business (14.30 - 15.30) the same day, not following day.

Anything I post is solely MY OPINION. It never constitutes legal, financial or collective bargaining advice. I may tell you based on information given how I might approach an employment dispute case, but you should always seek advice from your own Union representative. If you don't have one, get one!
