Car Insurance-didn't advise of previous claim and now charge being backdated

The OP does not say that she did not declare the claim in 2008 but it is obvious to anyone reading her post.
The Insurer back dated the AP to the renewal after the claim eg 2008, she is "Sure" she declared it last renewal eg Dec 2009.
Actually, the only logical conclusion you can draw from the information is that the insurer doesn't think she declared it.
Between us, we don't know for sure as the insurer [STRIKE]won't[/STRIKE] can't find recordings of the phone converstaion.
You are still assuming that the insurer hasn't made a mistake, but the customer did. That's just not a fair assumption.
