Car Insurance-didn't advise of previous claim and now charge being backdated

    You still don't get it, do you. The incident WAS declared...it's the insurer who has made the mistake. Why do you persist in blaming the OP? Oh yes, I forgot, you work for an insurance company, don't you.

    Where does it say that the incident was declared. The OP stated that they thought they declared it. That doesnt mean they did and the lack of documentation showing it was declared would suggest they didnt. Of course, that could be an error by the company but it could also indicate that the OP didnt tell the insurer.

    This thread makes a case for changing insurer each year, if there is any possibility of premiums being based on information that doesn't include all previous claims or offences.

  • Sadly the only reported and publicised claims are the ones that go wrong. Nobody seems to report the settled claims or satisfied customers. I work in the industry and we definitely need to get better at what we do but I can tell you there are plenty of claims paid where customers are given the benefit of the doubt.

    Possibly a more compelling reason is that often insurance companies offer renewals at prices that are twice what is available elsewhere or they would offer to a new customer. (which is arguably against the FOS “treat the policy holder fairly” ethos and maybe even the new inertia selling laws. Test case awaited with interest)

    Customer loyalty used to be appreciated, now it’s regarded as a windfall to be milked for all it’s worth.

    It's you who is not getting it.

    The client states they are sure they declared it last year eg at renewal Dec 2009. The incident should have been declared at renewal Dec 2008 hence the additional premium being back dated to Dec 2008

    If the OP had declared the incident at renewal 2008 when she should have, the insurer would have increased the premium then. If the client was not happy with the premium at renewal 2008 they could have shopped around

  • Just thought I'd update you all with the final outcome. After contacting the customer service dept directly to log a complaint they initially reduced the outstanding balance to just cover backdated premium for 2009-2010 as they coud not find any phone recordings to prove that they asked me of any changes in 2008-2009 or whether I had told them of the change. The difference in the additional premium amount had doubled from 2009 to 2010 and when I questioned this big change they agreed it was hard to justify that it could have increased by more than double in one year and they work this out based on statistics on claims etc. nationally to calculate their risk but it was understandable that I was confued by it. Anyway after the third email they concluded that I had been a loyal customer for 10 years and didn't deliberately withold information from them and agreed to waiver the amount owed and close the case, so I don't owe any additional money and as it came to light at renewal my policy wasn't cancelled I just didn't renew, so I have a cheaper insurance this year with a different insurer and no outstanding issue with my previous insurer!

    You're saying that the OP didn't declare at 2008, but you're guessing, because she doesn't say. Why, in the face of no evidence either way, do you persist in coming down on the side of the corporate and not the consumer? I think you're on the wrong forum. You should be on an insurance companies forum.

    Do you get paid by your employer to post on here?

    BTW, credit to the insurer for coming to an acceptable arrangement with the OP.

    The OP does not say that she did not declare the claim in 2008 but it is obvious to anyone reading her post.

    The Insurer back dated the AP to the renewal after the claim eg 2008, she is "Sure" she declared it last renewal eg Dec 2009.

    Try reading the OP and working out the dates
