    The OP is fully entitled to a refund, replacement or repair - as the length of time they have had the product is very short there should be no problem with them rejecting the goods and obtaining a full refund.

    Orange are just trying to fob the OP off but do not actually have any grounds to do so.

    Orange retail don't refund or replace Apple products, Apple don't let them. If you contact Apple with a faulty product they will replace it for you, there is no need to extend warranty etc. The info you got from the idiot at Apple is incorrect, ring 150 or 07973 100 150 for orange customer services and they will put you back through to Apple.

    Why is it just Orange who "aren't allowed" to do this? I work for Carphone and we're fully SOGA compliant and always have been.

    Because it's rubbish! Orange are allowed to do this, and legally have to do so, regardless of what they try and fob the customer off with. No amount of agreements or understandings overule UK law.

    While I don't remember much about the iPad side of things as I usually end up fixing them myself - the few that I've used Apple to sort out have been brilliant.
    And never have I had issues dealing with Apple directly with any version of the iPhone either.

    I used to at times send around 10 iPhones (which would be voda, o2 or orange branded) a week and Apple would simply replace them within 24-48 hours.
    Just yesterday a colleague received his 32GB iPhone 4 replacement within 24 hours and given it is Xmas/new years break ... I really cannot fault them.

    The ONLY difference between yourself and I is I have always done it online on Apple's support site - they give you options on whether to send it to them (they then send you a prepaid container to place it in) or to pop into an Apple store and make an appointment with a 'genuis'.
    I've always opted for sending it to them as it would be quicker than me travelling to my local store.

    Hi, a lot has been said about your legal rights, however Apple have a right to check whether this item is actually faulty before deciding whether a repair/ replacement is applicable. You have taken out a contract with Orange and that is a seperate issue. What if a customer had dropped an item and then just expected a replacement. Let Apple check the ipad and either repair or replace it. If it has physical damage claim on your insurance. It does sound more that you have changed your mind and want out of the Orange contract.

    Keith, Apple have no right to check the item or decide on the remedy which is clear in law. Orange may wish to check the item but if faulty then the remedy is cancellation of the contract and a refund. Many faults are obvious and don't need 3rd party to confirm them. If dropped then there is likely to be external damage that could be seen. Maybe the OP has changed their mind but that does not matter if the item is genuinely faulty.

    Hi, Hotspur , I accept your point however I dealt with electronic items for over 35 years and I disagree that physical damage would necessarily be obvious. A sudden sharp jolt can easily crack a circuit board whether it be an ipad, a tv or a mobile phone and quite often there is no external damage apparent.If the item is genuinely faulty then after being checked it can be replaced, no need to cancel the contract.

    Hi, my whole point was, that if there is no evidence of external damage the unit should be returned to the manufacturer or their agents for professional inspection. If it is a 'genuine' fault then I completely agree with you. However if it is found to have been caused by external damage ( for example a cracked pcb ) why should the manufacturer, the retailer or indeed, in this case , Orange lose out. Surely thats why we have insurance. My earlier reply meant to imply that an inspection was needed to determine if there was customer damage not for Apple to determine a remedy. Either it is faulty is which case I agree with you or it has physical damage and the customer hasn't a leg to stand on.
