Theiving Banks.

Has anyone ever seen anything like this?

My partner went to a derbyshire cash machine to take out £50, but it only gave her £30, so she went into complain. She was told to go to her own bank (Natwest) and they would have to complete a form and sent it to them. So she went to her bank and filled in the required form and sent it off.

She then didn't hear anything back to she phoned the bank and made an appointmen to see someone. At this appointment she was told that the derbyshire had responded to the form and said that on the day she said this happend they didn't find an extra £20 left in the machine and so will not refund the money.

I told her to open a second account at another bank, go into Natwest, tell them she wasn't happy and close the account, but she doesn't want to fight over £20.

Now in my book whether or not this was done by banks, this is still called stealing. The derbyshire took £50 out of her account and then gave her £30. Natwest deny any responsibility, but they allowed the theft from the account.

What do you do if you cannot even trust the bank holding you money??



ps. I was going to use "bank A" and "bank B", but then decided that these banks need named and shamed. If the moderator disagrees, feel free to censor the post.

    I'd agree that you should chase it up and though it's only £20, it's still £20! Really not sure what you can do though as it's not something that can be easily proved on either side really, I'd be at a real loss of how to proceed? But would definitely want to proceed!
  • Don't close the Natwest account, if Derbyshire took £50 out of the account and told Natwest it had dispensed £50 it really isn't Natwest's fault is it.

    Definitely take it further though, ask Natwest or ring Derbyshire customer services to ask what you should do as I really wouldn't know.

  • I would write a polite but firm letter to NatWest, if you are a good longstanding customer they should hopefully give you a "goodwill gesture" refund of £20. Cheaper to give you the £20 than the cost of losing a customer.

    I really wouldnt bother the police, unless you think someone was hiding in the machine ; ) unfortunately other then to make an official complaint to both banks and follow whatever the complaints system they have, there is little to do, and to move banks is an option, but hardly one to bother two organisations who make billions of pounds profit.

    A small claims court would not become involved as the complaint is uncorroborated and extremely difficult to prove or disprove. Again the man in the street stuffed

    not so - small claims are decided on the balance of probability - unlike higher courts where more proof is required. You can also not be sued for costs. Go for it - they will most likely back down.

    The balance of probability in this case is what ? As far as I can see from the OPs post its Derbyshire BS word against the OPs partner. There are no witnesses You must prove that they're legally responsible for the loss. You have prove liability.

    My personal feeling on this is that if it did come to court you will not win ! However for £20 Derbyshire might just decide the costs of fighting would not be worth it and they might just back down but don't bank on it !

    I also don't see the point of closing the Nat west account its hardly their fault that the Derbyshire machine didn't pay out. Go through the banks complaint procedure first
