Has any bank defended their actions in court?

hiya,
I am in the first stage of reclaiming my bank charges and just wondering if there is anyone who has not, or knows someone who has not successfully claimed their charges back? or who has lost against the bank? I know that it is claimed the banks have not yet made an appearance at court.
I'm probably just getting a wee bit nervous, but there must be some consumers out there who have lost!!!
I'm not trying to be pessimistic, only trying to keep a level head.0 -
Hi, I have just about started proceedings against my bank HSBC and the court cost is going to be £120 HSBC owe me £2116. I am now begining to panic as I cant afford to lose that money if I lose the court case. Because of this I need to know if anyone has lost yet? I have another account which looks like they will owe me a lot of money as well, but because of HSBC and their charges I had to go to a Debt management company. Please Help!!0

The banks will never defend a claim in court, as the last thing they want is to have to answer the question, in public and under oath, asking just how much it actually does cost them!
You cannot lose - you start the bidding high (the full charges), they will start the bidding low (the OFT's £12 per charge) - the trick is to keep on and on and on, ignoring all their attempts to divert you, bully you or highjack what is your complaint, until they pay up to get rid of you.The acquisition of wealth is no longer the driving force in my life.0 -

It is most likely their is a thread covering a Bank turning up to defend but if anyone has been to court and challenged by the banks I would like to spread the knowledge and pitfalls of bits to help each other out.
Their must be a time when a bank shows up so I am looking to see what others experience in the court land.

I can't ever recall seeing a thread about a bank turning up in Court to defend charges on these forums. If there has been a case, I'm sure someone will be along to point you towards the thread.
From all I'm reading, the banks know they haven't a leg to stand on to justify their charges, and simply won't turn up in Court. Judges are getting seriously annoyed about how much Court time is being wasted.

I am at the stage to take my bank (Barclays) to a small claims court to reclaim our unlawful bank charges. They have made us an offer of £1000 less then what we are owed but we feel we are entilited tio the full amount. They have refussed and now I am starting the procedings against them.
The thing is I would like to know if anyone out there has lost their battle with the banks when it gets to court? Thinking maybe I should just take their offer!

I've been in the process of getting my charges back from Abbey for about 4 months now! Thet court have only just issued the claim. Abbey dragged their heels whenever they could - probably hoping I'd get sick!
I don't mind if they do turn up in court. As has been said in previous posts, as long as you are prepared there is nothing to worry about. From following adivce the reason I submitted a claim in court is because Abbey refused to supply me with a breakdown of the costs incurred by returning a DD. If they didn't make a profit and only charged what it actually cost they'd have no problem supplying me with a true cost as they'd have nothing to hide.
The template I copied on my claim form stated that I'd ask for a breakdown and been refused hence the decision to pursue it in court.
I reckon I've got another few months to wait until I get my hands on my new Playstation 3!0 -

I've read a lot from people that are in the process of a claim or that have got a decent result (either full or by settlement) and it makes me wonder if there are stories where the end result has been a failure?
For the mostpart, I've not heard of anyone making it into court with the banks turning up ...
Have you been to court and subsequently lost?
Have you been offered a setllement, which you accepted, where the amount was less than 50% of the original claim? If so, why was it accepted?
Have you experienced some other stumbling block that has meant your case hasn't gone through or has failed in some way?We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers0
