I was just wondering if anyone knows the success rate of reclaiming bank charges. How many people have been completely unsuccessful? If so why?0 -
we hear lots about those who have won back their bank charges, some I'm sure settle for an offer, some may be too afraid to take things to a conclusion. But, I have yet to hear about anyone taking it all the way and not winning. Have there been such case (does anyone know) and if so could we be learning something from that. My son's claim is being defended - mostly I think it says (?) he hasn't the proof that the charges were incurred - I think that's because he didn't request his bank statements because he already had them. So we keep going - the case is also likely to be called after the end of March and I see that any claims could be the difference between what is and a new agreed charge. However, I very much trust that that will only be for new claims and not for those already in the pipeline.0

as far as i'm aware no one has failed yet but i dare say nobody wants to never say never as its tempting fate and since the majority of us here are still awaiting bank replies.....0

There have been a couple but only where the claim was ill prepared, not particularised, non compliance with court directions, where the claims have been struck out -- and one guy who employed a barrister who didnt understand the basic principles.... there has also been a guy in Northern Ireland reclaim the difference between the charge and the £12.88 odd the bank ''proved'' it cost them - very dubious - so don't put too much store in that one,

READ ALL COMMUNICATION FROM THE COURT PROPERLY

Oh yes - there are more and more people ATTENDING COURT HEARINGS - for ALLOCATION / DIRECTIONS / PRELIMINARY & CASE MANAGEMENT - sometimes the banks show and some times they don't - but if you get a hearing and they havent settled the night before (most will) then DO ATTEND...
Also a few are attending full hearings but the banks don't show up to those.LegalBeagles0
