I asked Littlewoods to send me a copy of my signed agreement and they sent me a copy of an agreement, but it was a blank one to sign. I sent it back in a recorded delivery letter asking them to send me my SIGNed agreement, not a blank one :rolleyes: within 30 days..still havn't heard anything though0 -

i contacted the trading standards after reading this post about the need for the signed consumer credit agreement and they told me that under sections 76 and 77 ( I think they were the right numbers) you have to send a cheque for £1 and request a copy of the consumer credit agreement that has been signed by both parties ( you and your creditor). they have 12 days to send this to you. If they havent produced it after 28 days then it becomes a criminal offence on the part of your creditors and trading standards would then need to take it up. so if you are requesting a copy of this make sure you put in your letter about the 12 days and also a cheque made out for the sum of £1. I have been requesting a copy of one of mine from HFC after a purchase of a computer from dixons that landed us with a money owing situation with HFC that we hadnt read on the advert ( and we still swear it didnt say anything about it on the ad. ) and they have fobbed us off for nearly a year telling us on some phone calls that it was on the way, on other phone calls that it would take a long time to get to us because they had to get it from their archives ... its been a nightmare. And at no point did they tell us that we had to send them a cheque for £1 or that they only had 12 days to send it. i finally sent all the correct stuff on by special ( not recorded ) delivery on the 14th June so I am counting the days down. But their service has been really inconsistent and what I would consider to be underhand. :mad: will post on the result if we ever get one from them!!:EasterBun ...what more do I need to say?!

So on the note of credit agreements etc, i have a slightly different twist.
I and the other half both have old debts which were barclaycards but long ago they went to Credit Security Limited. Mines about £1000 and i think hers is just less than this.
To be fair we are paying it off at about a fiver each a month, but, is it worth me writing to them looking for copies of the signed agreements or not?
If they have the files, i would assume that they have the full files and papers necessary?
If not, then surely they are collecting a debt that hasnt a signed credit agreement???

I used to work for a guy who had £250,000 of debt with the Nat West bank, he had borrowed it against his company (which folded) but it was a personal loan, he had Nat West chasing him through a collection agency and after many failed attempts to get money out of him they come to a deal where he paid only £2,100 for a full and final settlement.0

Ive tried to go the full and final settlement route a couple of years ago with these guys and they wouldnt do it :-(0

Can you tell me how you worded your letter? My sister in law has a catalogue debt with Kays that she can no longer afford to pay and it has been passed to debt collectors.
The only problem is that she has made 1 payment to the account, so i'm not sure how that would affect any potential outcome.
Anyone have any advice?0 -
Does anyone know, that if a credit card company could not produce a copy of your signed Consumer Credit Act agreement, whether they would have to 'reluctantly write off the debt' also?

We are in the processing of remortgaging to pay off about £25K worth of credit card debts which had got completely out of control. Had lots of equity in the property (about £125K) so were advised this was the best option.
We will be able to settle all the cards ourselves once the mortgage is completed and note an earlier message which said it was worth making offers to these people. I wonder if anyone has any tips on how much to offer them to clear the accounts. For example on a card with a limit of £5000, how much is a debt management company likely to accept to settle?
Advice would be appreciated.

Hi , I am new here but have been reading the tips etc for a few months. However after reading this post it gave me an idea but just wanted to clarify the details first.Okay first a bit about my circumstances, I used to be really good with money until I started to help my family out, you see all of them have bad credit and bad debts but no way of reducing them so I thought I was helping them by allowing them to use my credit cards to pay some of the debt ( as it was the only option really, too personal to explain ) and I also got 2 loans for them aswell. The result is that now on my credit file I look bad. Don't get me wrong, a payment has never been missed but I am maxed out on all 4 credit cards and the payments are more than my disposable income but I can hardly say that I don't pay them as they are in my name.
Anyway the idea I had was that although my family still have debts that they are paying off ( this is as well as the loans I have for them) they are only just managing to make it through the month sometimes they don't manage. My query is could they make an offer of settlement to the creditors even though they have been paying something each month. What they have been paying is nowhere near as much as it should be just that they have made an agreement with the companies?
Sorry for being so long winded.Any advice at all would be greatly appreciated.0 -

Just used your sugestion with regards to settlement and i have just bartered with a company that was asking for £1650 and just paid him £1000 and the CCJ is now settled WWWWOOOOOHHHHOOOO a very big thank you. I have used the other one on a ctalogue that i couldn't afford to pay this has been cleared today and i am in 1 hour £963 better off
