Good Idea, I'll check where the Ts and Cs are.
Yesterday was the last day I could pay, so I guess I am in the hands of whether the debt collectors wish to try and sue me.
Here is hoping.
I wonder if anyone knows anyone successfully taken to court by an APCOA related charge?0 -
Ok
So i have now received 2 letters from Roxburghe. The last of which threatens to pass my case onto Graham White.....seems like this is to script.
Considering this is not an 'unfair' ticket (although I wasnt discourteous, just providing an easy excuse to receive a ticket) what are everyones thoughts?0 -

It is unfair because it's not even a ticket/fine/penalty and the amount is extortionate. It's unrelated to any loss or damages, just a made-up figure.
It's simply an allegation of breach of contract, dressed up to look like a proper parking ticket. Stop thinking of it as a 'ticket' - it is only a demand for money which has no foundation.
And who are they sending the letters to - the registered keeper? They can only allege breach of contract against the driver, the keeper is not liable and they don't know who is who unless you tell them. Hopefully you never did send that letter telling them who was driving, admitting liability and offering them some money...that would not have been in your favour.
But these letters do just proceed as scripted, they are computer-generated threats with a facsimile signature, all issued in the Roxburghe offices. Nothing else will happen.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi
This exact same scenario happened to me in Swindon Railway Car Park in January. I have read up on this on here and therefore took no action to pay the fine etc and have now received my first correspondence from Roxburge. I was planning on ignoring it but we are in the process of re mortgaging. Is this going to effect my credit rating in any way? Will this company have filed any information on me yet? I am almost inclined to pay just to take the stress out the situation. We have found a very good new deal and I dont want to jeopardise it. Advice would be appreciated.0 -
The ONLY way it can affect your credit rating is if
a) They take you to court (won't happen)
b) They win (won't happen)
c) You then don't pay (won't happen)
Keep on ignoring
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -

They have no such powers. They are just a private limited company, like any old Joe Bloggs Plumbers. They can't do any more to your credit file than I can.0 -
I will keep on ignoring, thanks.
I have seen cars parked in areas with no marked bays in this car park before and they have never had tickets on them hence I did the same. I imagine they decided it would be a new way of making money to start "fining" people who were already paying them - a new trick. It there are two of us on here, goodness knows how many it has happened to who have paid up.0 -
scam-artists going by the name of 'meteor' patrol my local station car-park but not on a daily basis. the chimps rove from one park to another and may not 'inspect' any one park for days at a time.I will keep on ignoring, thanks.

this method of operating may well be in use at yr park - driving costs down and further enriching the 'perkys' of this world.
continue to ignore.0 -

We strongly urge you to seek independent legal advice rather than rely on these opinions, and we would respectively suggest that you refer to the Civil Procedure Rules part 31 and more specifically parts 31.16 and 31.170
