Hi have sent account in dispute letter and sar request to barclays. Have now recieved a 72hr letter do i need to do anything else ?0
-
The "72 hours until Litigation" notice is a standard threatogram. Don't worry about it, I have had several over the last few years, empty threats and don't know anyone who has had them carried out (and believe me I have seen a lot of these). If HFO wanted to take you to court, they do it. If they think they have a good case.
While the account is in dispute they cannot legally take you to court anyway, as that would be enforcement, which is not allowed0 -
Okay cool thanks thought it was the case as it wasnt sent recored this time so guessed it was a threatogram. And the fact we still havent recieved the statment off account made me think it wouldnt go far.
thanks for all ur help.0 -

Hi have recieved a copy statment off account off them from mar 2006 to march 2007 the last payment made was 1o may 2007.
I guess we have to now set up a payment plan with them ?0 -
No, not at this stage, plenty more life in this yet. They haven't sent you your credit agreement yet. The statement of account is this from the origional creditor or is it from HFO?0
-
Ok just re-read your thread and remember that you received an application for credit. Just going to to a bit more reading and speak to one of my buddys' from the CAG forum.
This by all means is not panic stations, so don't get worried and start offering repayment terms.0 -
Did you send a SAR request off?0
-
Hi yeah sent a sar request still awaiting on that because the last payment was 2006 is it still valid ? I would say it was a hfo copy personally as it dont look like any statment i have recieved.0
-
Regarding the SAR request they should be sending you all the details they have on record, they must go back 6 years at least. I wouldn't believe any thing from HFO.
Regarding your agreement , this is still an application for credit and HFO would find it very difficult to try and enforce it in court and probably wouldn't try, but i don't guarentee that. They haven't tried to enforce mine or my dads and it is no different from yours. So confident in enforcing my application for credit they offered me a 90% discount.
Let me have another read through the thread and look how to proceed from here.0
