my friend a pair of shoes for her grandson 4 weeks ago, his feet were measured by the sales assistant and she said he needed a size 4 1/2, which my friend bought. At the weekend my friend noticed that the shoes had split across the back and the sole, it's obvious by the kind of split that it's a design flaw in the shoe. Yesterday my friend took the shoes back to Clarks, unfortunately she didn't have the receipt, but the shoe is a pretty new line and the SA said she could remember my friend buying them. They said they would replace the shoes but my friend asked if she could have a different design as she thought it was likely the same thing would happen again. The SA agreed and then said she would have to re measure the Childs feet. She did this and he has gone up a size, so they then refused to exchange the shoes at all!
Can they do this? They had agreed to an exchange because of the split then because they decided he's grown (but they also said that the split shoes still fitted him well as they allow for growing room
) say they can't/won't replace them as they can't fit shoes that are the incorrect size (according to their measurement machine thingy) Also if they fit them with growing room surly they should have had more than 4 weeks worth of growing room in them anyway. My friend disagrees that her grandson has grown (he lives with her) as all his other shoes still fit him perfectly well anyway and thinks it's just an excuse to get out of exchanging them.

If they cannot repair or replace them you are entitled to a full refund.S!!!!horpe0

If the shoes are faulty, you are entitled to a refund regardless of the child's feet.
The Sale of Goods Act covers this. Look on the CAB site for the proper wording. Once you start quoting it in shops, they are more lenientHere I go again on my own....0 -
Ahhhhhhh Clarks! I went to them with my son for his first pair of shoes becuase i wnated them fitted properly. He was a 4H, but they didnt have any of the size in stock so began pressuring me to buy 4F 'there isnt much in it really' im told! What a joke, if the width is a h then buying 2 widths smaller is going to be bad for growing feet. They were meant to ring me once 4H's came in to stock - still waiting a year later. Grrr clarks0

the fact he has now grown doesnt matter, my sons shoes were fine but he was saying they were sore so i took them and him back to clarks and they said they had probably been fitted incorrectly as feet do not grow that quick in four weeks, i had new shoes of my choice ,
im sure she is entitled to new shoes of her choice or a full refund on the faulty shoes to then buy some else where
as she doesnt have the reciept if shhe paid by card then they accept bank/credit card statementsIf you want the rainbow you have to go through the rain.

I have worn Clarks shoes for nearly 30 years and never had a problem untill recently but having taken back 2 pairs in 12 months when all previous pairs have lasted over 2 years. I can only conclude that the quality is now the same as a £10 pair from a market stall since they moved manufacturing to the far east .
I have found the shop staff arrogant and obstructive and determined to pass the blame onto missuse by the customer and the head office complaints staff even worse.
When I have redeemed the voucher in my wallet for a pair in the sale ( I refuse to pay them any more cash as the prices have increased ) then I shall no longer purchase from them again .
I am at the moment wearing a pair of boots that I bought at Lidls 3 years ago for £12.99 which are still in good order so cannot see the point in paying nearly £80 for Clarks overpriced shoddy goods !

Every couple of pair's of Clark's shoes I have bought for my daughter I have had to take back. They split at the seams, the bar across the foot rips and don't wear very well. I had to ring their head office to replace the last pair. It seems if there is a fault with the shoe, they will find a pair and have them sent to your local Clark's shop. Only found this out because I said I lived in Kent and couldn't get to Liverpool within 10 minutes to collect!!0

Unfortunately my friend paid cash so she has no proof of when she bought them, though they are obviously clarks (and the sa said she remembered her buying them) We went back to Clarks today (I went along for moral support and to quote The Sale of Goods Act) and they are still refusing to budge, they say that because my friend lost her receipt they won't refund and they are still sticking to the co policy of not supplying shoes that are too small. I argued that they had already done that because according to them the shoes have become too small in just 4 weeks and that they say they allow around 12 weeks growing room in each shoe...the deputy manageress (manager on holiday) said this was just an "aim" not a promise as they have no control over growth spurts!!
The did offer a 20% discount off a new pair of shoes as a goodwill gesture :rolleyes: . So now my friend has asked me to email Clarks via the website to see if she can get a exchange that way.0 -
I hate clarks kids shoes now. My friends and I have had endless problems with the local clarks shop. They've sold shoes that clearly don't fit and are poor quality and very overpriced. Your friend is entitled to a refund or replacement as they clearly not fit for purpose. Try and get trading standards invloved if they get stroppy.
We get chipmunk brand ones now. Found them excellent quality and fab price.0 -
The price of kiddies shoes is way too high, my daughter is 3 and the last pair was £26 now considering there is no vat on kiddies shoes this makes them £30.55 comparing with adult prices, they must use a third of the material as well :mad:0
