Phone Broken 17 months into a 24 month contract, where do I stand getting it repaired
Hi all, just wondering if anyone has had similar experience with anything like this before. I'm on O2 and got my contract through e2save in August 2009, on a 24 month conract. My phone broke on 24th December however and I'm now wondering where I stand.
Looking on the e2save website I apparently only get a 12month warranty, but yet the phone clearly isnt fit for purpose, so surely breaks the sale of goods act as I can't use it for the duration of the contract.
Anyone else had this happen? If so have you had luck getting phone repaired/replacement?
Its a sony ericsson W995 phone.

i would expect you have a 12mth warranty - after which your phone is your responsibility. Did you take out insurance? If so you should be able to claim on this. Otherwise, if you want to get your phone repaired you will need to take it into your O2 where they will send it off and let you have a repair quote. Im only chiming with my opinion here and it has no factual basis:
The phone and contract are 2 separate transactions
When you take a contract your phone provider agrees to sell you a phone at a discounted price (often free). That is the end of the transaction and just as if you was to buy any other item from any other store it is only covered under the manufacturers warranty. The fact that you have a 24 month contract is just a separate issue. See the phone as a thank you gift and the contract as your actual purchase. Networks will not get themselves tangled up with being responsible for handsets for the duration of the contract regardless of warranty status, and the current method where they can pretty much ignore you seems to suit nicely.Hi, we’ve had to remove your signature. You have a two year warranty with Sony Ericsson. Pop into a Carphone Warehouse store, they'll send it off for you. Usual turnaround is 14 days.Have I helped? Feel free to click the 'Thanks' button. I like to feel useful (and smug).0

yes w5995 does come with a 2 year warranty, if water damaged buy one from carphone warehouse0

I had a Sony Erickson C905. That gave up after 17 months of an 18 month contract.
O2 sent it off and repaired it free as that had a 2 year warranty. I agree with the previous poster. You are covered.True Friends Are Hard To Find, Harder To Leave And Impossible To Forget.0 -

I have an hTC Hero which is beginning to have intermittant touchscreen problems. I got it 15 months ago so am very interested to hear that there is an EU directive for manufacturers to provide a 2 year warranty. The only problem is that at HTC's website they specifically state it is only 12 months and anything older will be regarded as an out of warranty repair.0

The trouble is, it seems, that EU directives need not be law in this country until they are "passed" here. That one does not appear to have been.

Yep, 2 years. If you take it to an 02 store make sure you take POP as well as they won't have a record of the sale if it was through E2Save.
