    Would the NMW rule mean that anyone that was working for NMW could never pay back any money while they were still employed by that employer as they'd always be earning under NMW if they paid anything back at all?

    Payslips always have gross pay written on there somewhere. Dividing that by hours work to get hourly rate or multiplying by 12 to give salary should have indicated if things were adrift. If the tax is wrong then that might be different as it is less clear as to whether an employee should be expected to understand what is correct if the payslip is complicated.

    If they have overpaid over 3 months then I'd expect them to regain that money over a minimum of the same time. You have to be at least paid NMW for hours actually worked.

    To be fair to the OP, not everyone understands about payslips, hours worked, gross and net pay. Payslips can be complicated and hard to understand especially in anew job. Your employer has dealt with this really badly and you need to try and negotiate with them further. you may not get money before xmas, but at least something for next week would be good.

    If you have no luck with your employer, you may be eligible for a hardship payment of some sort. you could ask on the benefits forum to see if there is anything which can be done. Could you get a short term loan from a family friend?
  • The main concern here is that the employer hasnt given the OP any prior notice that their wages would be taken this month and next to clear an over payment .

    IT IS AN UNAUTHORISED DEDUCTION.

    Personally i dont think the OP should be running around just days before xmas trying to beg money from friends and family !

    It is a very uncaring employer in my opinion !

    I would try and speak to CAB (are they open today??) to see if your work are actually permitted to do this, as it seems more like an unauthorised deduction.

    I'm sure they should have made you aware of this mistake, and agreed a payment plan to pay back the money.

    I'm surprised you didn't spot the mistake thought, as £1200 in just 2 pay packets is a HUGE amount. If it's going to take 1.5 pay salaries to pay it back, then that implies your normal take home pay is £800/month, and you were receiving £1400 instead!

    I said about the unautorised deductions in posts 12 + 15.

    In saying that , i am another one who cant quite figure out how the OP didnt actually notice the overpayment !

    A small amount may well go un-noticed but £1,200?

  • Not sure about it being a deduction as the money has already been paid in advance. This is just the sort of situation that a rainy day fund comes in handy or at least the ability to get credit to tide us over.

  • This is the 4th payday i.ve had... and as i said i have done varied amount of hours.. also found out today that a few of us haven't even been paid for extra work we had done . this will be paid january .. so there are a few problems with the payroll system. Thanks for the advise and i will be seeking advise next week...

    that's not necessarily a 'problem': our system is that your contractual hours are paid at the end of the month you've worked them in, but any overtime is paid the month after that. makes sense, because the payroll has to be finalised mid month, so no-one knows until the end of the month what overtime anyone is due.

    so in Dec we sent off a list of overtime worked in Nov, and by mid Jan we'll have authorised a list of o/t worked in Dec and so on.

  • well, to help you in future, if you know how much you are paid per hour on a normal week input it into here:

    as this will work out how much national insurance and tax you will need to pay based on you working the same all year. Sounds a bit rubbish of them, but best thing to do is to keep a running tally over the weeks on the computer as then you can work out what you have earned and then if you are due any tax back or need to do a self assessment for whatever reason then you have it all down on the computer ready. If you are saleried then it will also help you work out what you should be paid on an average week, same for monthly etc.

    If this is a GMRC balls up (quite possible), this is obviosusly beyond your employers control and are being directed by what HM Revenue & Customs are advising them. Even still, I would check the legalities of this and ask for their co-operation especially at this time of year.

    I've had instances where my employers have been unable to pay me via the normal BACS system (due to system outages) and have made arrangements to collect wages in cash or cheque form rather then the standard BACS.

    Once you find out WHO has withheld the money, then you can go from there and either advise your employer your rights or ask the HMRC for a repayment plan rather then a bulk payment sum.

    If your employers ARE at fault here, why should you be left without your basic salery becuase of some !!!! up on your employers part or another employee of theirs?

    If it is the fault of your employers, I would basicly insist that as you have helped out by doing extra hours and ask that they return the good deed and provide you some assistance with some kind of payment plan or at the very least, repay the sum at a reduced amount then at the current rate!
