Please help- will I be prosecuted?

I's really appreciate some advice please.

Situation is earlier this morning I went to M&S in Dunblane to colleact a food order for my mother. It was chaotic to say the least and there was someone directing traffic who pointed myself and many others to several others areas near the shop (this included a couple of car parks).

I parked in one of the car parks next to what I believe to be some sort of Community Centre.

Anyway I collected the food and on returning to the car was approached by a clearly very irate woman. She asked where I had been and I explained. At that point she told me it was a private car park and I would be prosecuted for parking there.

I apologised and explained I wasn't aware of this and had simply followed the directions of the warden/parking attendant. To be honest that just seemed to inflame the whole situation, at this point she became pretty abusive. She informed me that my registration details had been passed to both the traffic police, local police and the prosecution dept? and that I would receive a summons to court at which point she said I could "give my pathetic excuse to the judge".

I've tried ringing the local police in Dunblane and the Central Scotland ones but there is no one who can help me right now as they are busy.

Can anyone help here - if I'm in the worng then I'm truly sorry, I did as I was asked to and I'm really upset about this. I also had by husband's car so the summons will come to him and he will go absolutely mental. If there is anyway I can get it sent to me I'll do whatever I need to so it isn't addressed to him.

I've also tried ringing M&S at Dunblane but can't get through.

Sorry for the long saga but I really don't know where to go next.

  • Relax, you cannot be prosecuted for parking on private property. The woman that abused you was talking out of her hat and the police will probably tell her where to go. NOTHING will happen.

    You cannot be prosecuted, it is not a police matter, I am sure the procurator fiscal has more pressing issues to deal with. The only thing you could have been prosecuted for is running over the silly cow on the way out. :D Any parking or trespass issue would be a civil matter. Forget about it, you will not hear any more about it. You were in the wrong but you being truly sorry is all they are going to get.
  • Thank you both. I was absolutely panic stricken. I now realise it was stupid to have blindly followed the M&S parking guys instructions - clearly he just wanted us out of his way but at the time I didn't think anything of it.

    One of the things she kept yelling was that this was a charity or a charitable trust and people who abused them were just scum. I didn't see any signs saying it was a private car park or that you couldn't park there but then again when I left I was in such a hurry to get out I didn't look any further.

    I'm not local to the area but I was shocked - I thought Dunblane residents were a bit more genteel than the harridan I encountered.:D

    Come to think of it if the car park belongs to some sort of trust why didn't they just ask people for a donation. I'd have been happy to give them something.

    I might try to find out who it belongs to - I know her behaviour was out of order but it's not something I would ever have done knowingly and I feel bad so I'd like to apologise properly.

    LOL, she sounds just like a miseryguts woman I used to work with, completely mad, full of her own importance but it's all bluff and bluster! There's no 'offence' about parking on private land, even alleged trespass is not a criminal offence!

    The old cow I worked with used to yell blue murder at people who parked in 'our' spaces that they would get their cars clamped. Funny there were no clamping signs and one day the landlord stopped by and I asked him about the alleged clampers. Of course he knew nothing about it, did say he could call a private parking goon to come & put tickets on cars if we wanted...I said no thanks! People might have been taken in by their fake tickets.

    Stop worrying, this is NOTHING. Stop trying to call the Police, she was a mad woman.

    2 days after taking delivery of a brand new SUV I parked it in a health club car park and came out to find over £1000 of damage. The health club had no CCTV, the police weren't interested and we had to foot the bill (chose not to put it through the insurance)

    This would just have been yet another bill because I'd been in the wrong place at the wrong time. We both work hard for our money and are carfeul with it but so many times it looks like I've thrown it away.
