I was told by the Sheriff Court when I contacted them that they could not question the jurisdiction of the Sheriff, and if they had a problem with this they should have said it at the hearing. I must admit the Sheriff was really understanding and advised me not to miss any payments of the agreement. What is really stressing me out is the !!!!!!!! that I am still gettting from the Cheque Centre even though i have been given the time to pay direction with which I fully intend to adhere to. I would like advice on who I could report these morons to,surely. they can't get awy with all this harrassment

I also have a frozen pension and I am trying to get some money from that to get this company off my back. Cheque Centre are really something else I wish I had never heard of them. Legalised knee cappers thats what they are.

    Hi Pet Owner

You are doing exactly the right thing - follow the Sheriff's decision, don't miss payments and keep all receipts and proofs of payment. All they are trying to do is bully you into giving them the money now (that you don't have) and hoping that you feel pressured enough to give in.

Sorry, but I don't know who they could be reported to - perhaps CAB could help?

    Hi Wee Pilsbury

One thing is for certain they are really stressing me out. But I will certainly stick to the payments. I have set up a Sttanding Order with the Bank,so the payment gets taken off the same time every month. I was told that they wanted my card details, I told them where to go not very politely either. Did they honestly think I would fall for that one after all the worry they have put me through.

pet owner - hi - I know in England that they are legally allowed to take money from your bank account - I believe it's something to do with the permission you give when you sign up for such a loan but getting a wages arrestment? they can't do that without knowing your employers details and I wouldn't have thought you have to give them then and even then surely they can't do that without a court order? certainly in England people can't just write to your employer and ask them to take money out of your wages - they have to go to court - I would imagine there are similar safegaurds up there in Scotland.
The cheque centre certainly sound horrid - of course they have to obey the law and what the courts decide - are they complete morons or what?

Despite the debt spiralling out of control, I never received any letters from them, they just told me verbally that the debt collectors could pay me a visit and I think one day, two blokes were at my door in blue shirts. Now thankfully I could see out but they couldn't see in. They tried to open the door, luckily it was locked from the night before. It sure got my heart raising, especially when they knock on your door at 8am. So yes, they are able to send debt collectors. Just in case, keep your doors locked, I think they have the right to attempt entry for a debt settlement.
They do not have any such right. If they try that trick again, report them to the plods.

I doubt that they are complete morons, as they appear to have no pre-frontal cortex in their (somewhat lissencephalic?) brains.

Alternatively, they may be afflicted with Lateral dorsal lesions of the pre-frontal cortex. :p

Cheque Centres legal dept are nothing but a load of lying bullies, their Staff are not nice people to deal with.

First off can I say, I totally believe you. Please don't stop believing youself on this. Under enough pressure all normal human beings can be made to doubt themself, they will keep applying in the hope that your personal level of "enough" is within thier reach. I don't think for one minute you are lying, I don't think for one minute they are telling the truth either. Write that quote out above and stick it to the fridge. No really. You will, sooner or later have a weak day.

Spogg are you a plant? If you're not a plant you're woefully misinformed and you're doing a really good job of herding petowner away from what is in her own interests and towards what is in Cheque Centres. Petowner I suggest you unthank Spogg and ignore everything that he has said. Some of it is downright dangerous, as Culex has already begun to outline.

Wee Pilsbury, on the other hand, is a genuine resource. I don't know as much as I would like to about Scots law but I do know that Sherriffs are not to be messed with, at all. What Sheriff says goes. It's that clear.

petowner if I can give you any 1 peice of advice above all else it is stop phoning them. It is the thing you do that is most self-sabbotaging. Your opening comment was right, they are liars. They say things on the phone that they would never dare put in writing because they know you can't prove it. Even if you could record the calls (which hardly anyone can) you would by law have to tell them you were recording or you couldn't use it. So they know for a dead cert they're gonna get away with it. So far you have correctly identified several lies. How many lies slipped by you without your realising? You can't say, because if you knew then they wouldn't have slipped by. Worrying whn you think about it.

So, as of right now it's time to play hardball back. Anything they can do you can do better, with the right pointers of course. Here's a starter for 10... The Golden Rule and safe payments.
I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)

As of the last count I have cleared
    [STRIKE]23.16%[/STRIKE] 22.49% of my debt. :(

Is there no way you can get family and friends to help with the repayment.
Turning a debt with no interpersonal relationship consequences into one that could end a relationship or start a fued? I wouldn't. Petowner can deal with Cheque Centre the usual way just fine. Their arss is every bit as kickable as any other creditors.

Failing that sell stuff you might have, live on bread and water for a few months etc.
The debt charities would flay you alive if you said that on thier watch. Nothing, and I do mean NOTHING is more important than food. This is terrible advice.

You seem to have gone through a lot of hassle for not exactly a fortune.
This I agree with. Life is sometimes totally unfair.

The warning/lesson here seems to be don't take loan money you can't afford to pay back with these people, or unlike others who threaten action they actually will act.
Careful now. That skns the no judgement rule a little closely. It is not thier legal actions which are causing disdain, it's the illegal ones.

EDIT...One final thought, your boss doesn't seem to unsympathetic can you not get an advance on your salary and pay your company/boss back over a year or so.
Again turning a private debt, with no interpersonal consequences into a bad feeling with the boss in a time of economic instability? I wouldn't.

Petowner doesn't need a quick stage-exit, she can do this perfectly well the usual way, she has rights, she has the balls to demand them, she's clearly plenty bright enough and she's rightfully annoyed. The whole set of tools then. She'll wipe the floor with them if she gets stuck in, she just needs to know where to start.
