currys harddrive problem

hi i dont know the full story but a friends laptop wouldnt power up so they took it back to currys for repair,when they collected it they were told that the harddrive had been replaced and that the old harddrive had been sent to be destroyed. i might be wrong but shouldnt currys have given them the old harddrive back or at least informed them that they were sending it to be destroyed so that they had the option to have it back?

  • thanks for your quick reply. do you know of any leagaleese they can quote down the phone because the woman they spoke to said that it was in transet to be destroyed and that she couldnt guarrantee that they could get it back

    always a difficult one/ they could very well throw the onus onto you/your friend /you should have made a backup etc. not suggesting that's true -- but their get out clause , so to speak ?

    In a word no. they have replaced it with an equivilent hard drive, having data backed up is always the owner/customers sole responsibility, common sense dictates you do this yourself befoore handing your machine over to be sent god knows where and be tampered with by some DSG group oik.

    and in any case the above 'basic common sense' will be backed up by very robust Ts and Cs on their part.

    your friend hasn't a leg to stand on I'm afraid

    If he took it into Currys then the standard T & C which he signed says Currys are not responsible for data lose and the onus is on the customer to backup.
    Currys are well within (as most companies do) their rights to keep the hard drive as they can claim back from the manufacture (either HDD or laptop).
  • just wished they had told us first my hubby works in IT and can usually retrieve data off dogy harddrives and could have probably fixed it for a fraction of what currys charge (just parts no labour). if they can get it back hubbys going to have a go at getting their files back.

    Oh well if it was outside of warranty then Currys either would of charged £229 and sent it away (and the HDD is usually returned with the machine) OR done the work in house (in which case the HDD is ALWAYS returned to customer)
    If it was within warrenty period then the repair was FOC and currys keep the hdd, you can phone up and request it as for a small period of time the replaced parts are kept with customer details/job no, especially for these cases.

    *Edit* You can request the HDD sent back, but they are under no obligations to do so. Unfortunatly always, always, always back up, it saves time, problems and money in the long run. A external HDD (Seagate 250gb costs £29.99 from Pcworld/Currys (The new 2.5" modular USB3, FW,ext SATA) )

    I think giving it to any friend with 'basic common sense and the ability to use google' is usually sufficient to ensure a much more competent diagnosis and repair than the Curries/PC world monkeys are capable of.....

    Unfortunately he should have thought of that before taking it for repair. I had a hard drive fail in a Dell laptop under warranty. They sent me a new drive with packaging to send the old one back by return. But they agreed for me to hold on to it for a week as I felt it could still be accessed and wanted to erase everything on it. I kept it a week, during which time I was able to wipe it, then I returned it. No problems from either side.
