phone not powering up 50% of the time.

hi guys and gals
right, basically i have a samsung pixon m8800 and am 18 months into a 2 year contract. the phone has not been abused, and apart from a few scratches from being in my pocket, is in perfect condition.
the last few days, it has not wanted to power on, i have to take the battery out several times and several attempts to power up before it actually works. now and again it just powers down randomly too. is this my own problem, or 02's?

Think its Samsung's problem - if its under warranty.0

samsung give a 12 month warranty, which im obviously out of, but i am on a 2 year contract. surely the phone must be able to fulfill the contract term. the phone still belongs to 02 till that point doesnt it?0

Could be battery _ I have had that.
Could be charger - I have had that
Could, of course, be handset.
As for guarantee period, warranty, check out Sale of Goods Act and then take it up with whoever sold you the phone - not Samsung. At the moment, if it is the handset, you don't know if it has been damaged somehow or if it was badly made.
