fileserve account hacked. terms & conditions state they can't do anything???

hey guys
i really hope you can help.
i joined the file sharing service. fileserve
my account has been hacked and I have emailed the company but not recieved any reply.
there terms and conditions state
My account was hacked. Can you give me new password or account?
"It is your responsibility to keep your account information safely secured and stored. We will not respond to such mails, nor will we be able to help you out"
i think this is unfair. they dont have the right security measures / security questions for an account to be retrieved to the rightful owner
now i paid via paypal. can i open a paypal dispute? Can the company get away with such conditions...which make no sense, because a hacker (im not sure how it works, but surely its not a matter of me just keeping my password safe??)

nope. but the email account it was registered to *that account* has also been hacked. i was already logged in my browser (via cookies) i can see someone has amended the email address, but i cant take ownership as they have changed the password.0

Why not encrypt what you store there on their servers so it is unlikely it is any use to anyone else, and are you sure your email account has not been hacked into thus allowing others into your stuff on fileserve and elsewhere?

filserve doesnt have any security questions hence the poor t&c stating they can't do anything. even if i had control over the email address i was registered with i couldnt really do anything. as the hacker has changed the registered email address and password.
is it worth opening a paypal dispute? i have evidence its my account (paypal id transaction) but i can open dispute that this service is not what i was expecting. i think its highly unfair..0 -
So what it boils down to is that your email account was compromised somehow and whoever got into it found the fileserve login details which were emailed to it when you bought the account which you hadn't changed.
You could try a PayPal dispute - I doubt you'll get anywhere with it but if the hosters will not sort it out for you it's your only option.
If you buy another account make sure you change the password and use a different email provider too.0 -
im not sure what was compromised the fileserve or email first, i guess i will never know. its my fault for them having the same password i guess.
i was just hoping i could challenge them on the terms and conditions as im the rightful account owner...0 -
Ah - I didn't realise they had the same password - that is a common mistake to make.
They'd need the account id as well as the password though and my betting is that will be sitting in your inbox so my money would be on the email account being the weak link.
I'll agree that it's unfair of fileserve not to have some decent method of resetting a compromised account.0
