advice needed about being made to stay after work hours.

    Once the new job offer is unconditional.

    Put in a grievence for paying less than NMW for all the 1/2 hours that they owe you

    Then resign.

    Make sure that you say that underpayment of hours is one of the reasons you are leaving, if the workplace is part of a larger orginisation make sure that is communicated upwards.

    thanks for the advice i will check with new job tomoro and think about waht to do next . i do like my manger so i feel bad for thinking about it but its getting longer and longer i have to stay after shifts and 40mins last night! honestly probs wont do anything but its nice to now for future .thanks guys.

    It seems very sad that this sort of thing should happen to anyone let alone someone on NMW.

    This is the sort of thing that employers do during tough times so they can squeeze their employees to the max.

    In my job, if I am over time, I can claim overtime because my union agreed it with the management.

    Good luck hob and as someone else has said put it down to experience and go and enjoy your new job.

    I work lots of hours after hours that i dont get paid for.

    May I ask why you do this ?

    My son has the same problem where he works, and when he was moaned at for not doing 'the free overtime' as he puts it. He told them that he thinks 40 hours was enough, he was told with that attitude he should work for the council. This is an office based job and he is on 6 months probation which ends in January so watch this space. I have suggested that he does it just until the 6 months has passed, but he will not. Fortunatly he has a job that is in demand so he has never had problems finding work but that may change in current times.

    Bleeding cheap B@stards...I have a lot of sympathy for you but if other muppets are work are going along with it, there's not much you can do.

    If it was me, as soon as the reference call was made I would be leaving right on the dot. I mean, come on - how much are they saving by not paying the extra 30 mins per day, £15 per week? And I am saying this as someone who earns a relativley high salary and is usually conservative :)

    I would invoice them for this time after you have left mentioning NMW and an ET if they do not pay up.

  • My mum works for the Co-operative on NMW and when the shop shuts at 10pm, if the alarm wont set or there is a security breach, she is expected to stay until the matter is resolved, without pay! This happens about once every 2 months. Usually it is until about midnight but the other night someone had to stay from 10pm - 5am!

    She is not a manager or a supervisor.

    I cant believe that it is legal, but she says everyone just accepts it and doesn't kick up a fuss about getting paid the extra!

    This is wrong - but very common in retail. until people start making a fuss it will just continue. the problem is that young people tend to work in this industry and don't know what their rights are. All it would take would be to allow you the odd long lunch break or late start to make up for it, but managers just don't think it is a big deal.

    I used to have the same problem, but it caused me to miss the LAST bus and i had to get taxis home. On minimum wage this made it not worth working at all.

    I beleive you should make it clear that it is not acceptable to you and you are in the best position to do this. you could make a big difference to others who work there. As you are leaving you could take the issue to upper management once you are in your notice period. they can't do anything to you at that stage and you could be making life easier for everyone else.

    Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..
