12 year old son, doesnt want to go back to PWC

    I havnt spoken to the PWC for 2 years she wont speak to me, after taking her to court. and ive heard with my own ears the way she speaks to him on the phone let alone at home, and ive seen the text messages she has sent him with threats If he wants to see me out of the arranged times and days.

    If you have real concerns give CAFCAS a ring and tell them what is happening. Do you remember who your case officer was, speak to them?

    chances are at 12, he could just come and live with you if he wishes. if you have PR and the child is basically too big to be carried then the police wont get involved.

    it would then be down to the pwc to take it to court. that's one route.

    the alternative is to file for residency and chance your luck on getting a half brain cafcrap officer and a half decent judge.

    gillick competency is still hit and miss in family courts. it was a medical precedent and is slowly filtering through into family law.

    in fact, my friend has just finished studying family law at uni and was taught nothing about it. the only reason she heard about it was through me, so you cant rely on this angle being successful.

  • Seen this all before, CAFCASS sided with PWC CSA charged 40% levy, made homelss & I went back to sea.

    Got a tip off her new BF was dealing Class A in my house and I emailed crimestoppers anon, both arrested and remanded for possession with intent to supply 1Kg of Class A. I got the kids back, possession of my house (sold it quickly) and the CSA problem ended and I resumed working family life again. Kids are loving it.

    If your kids are being mistreated then contact social services with some hard evidence. Dont bother with CAFCASS, I found them very oppressive towards working dads even if mum is a lazy unemployed cigarette-smoking vodka-drinking smackhead.

    thanks for the straight to the point answer i was looking for,

    I wanted to find out all the facts before it finally comes to a head and my son walks out as i think thats what is going to happen,

    he came to me today and asked all these questions ie police/court/"lady at cafcass". and would he get into trouble if he lived with me...

    am going to get xmas out of the way, find a few facts out.. and leave it with my son, and see if he feels the same after xmas..

    thats crazy, doesnt sound to far off my case,,

    the top and bottom is her 2 year new partner is a ex class a user and dealer thats why i went to court, but couldnt prove the dealing but because he was on a so called "rehab program" its ok eh..

    now his home life is not very good ie, PWC drinking new partner still on a "program" !!
    and she now has 2 new children in a 3 bed house the 4 kids living there, and theres a lot of anger and problems in the house hold..
  • Your remedy is most certainly Social Services. This is not the right forum to debate it.

    Have a look at Parentline Plus not only will they be able to offer you advice and support via their free phoneline, they may be able to send your son some information written for his age group for him to read either with you or by himself.

    I think the important issue is to ensure you explain to your son that you are listening to his wishes and you fully support them but it can take time to sort these things out and that it is important that things are done correctly.

    Not sure how mature your son is, but perhaps agree to sit down together each 1-2 weeks to feedback to him what steps have been taken and any results, good or bad etc.
