12 year old son, doesnt want to go back to PWC

Few years back I tried to get full custody of my son,
cafcass where involved, the PWC played mind games with my son and he was a lot younger then and the PWC influencent what my son said to the officer. As he has later told me of his own accord....
Now a few years have past my son has seen the PWC true colours. and see she isnt offering a good stable home inviroment.
And now he has been saying he wants to come and live with me,
but the PWC says if he come and live with me she will get the police involved,, "AS THE COURTS SAID HE SHOULD LIVE WITH HER", (mind games again)
then she has also said if he goes she doesnt want nothing to do with her own son..
Do i go back to court or do i arrange a meeting with cafcass again.
at the moment is see my son 3 times aweek and half of all hols..
where does to law stand if the police turn up at my home address, will they take into account what my son says..
I know its not a benefit matter but am hoping someone can shed some light on the matter.

How old is your son ? - As I belive after a certain age they can make their own mind up . Not sure what age though.

In my case, my father had custody (& he was wonderful :-)). The courts ruled that I was to visit my mother alternate weekends until I was 12, at which point it was up to me whether or not I wanted to go. Not sure what the score was though had I decided that I wanted to live with her.0

It is not a certain age, but it is when court deems the child "Gillick competent" which is pretty likely to happen for a 12 year old.
He is likely to be able to choose.Please do not confuse me with other gratefulsforhelp. x0 -

If am truthful the solicitors around here are very very bad,
I rang around before i picked one and was told this guy was the best around,
all he could do is go on about how busy he was and had 6 other court apointments that day,
and when i told him i dont care about them cases my son is the top priority, he didnt like that, and he was ment to be the best in the area...
and just wanted to send letters and as soon as we where in court wanted to be out of there.....
but I do have a work union solicitor I can phone ..0 -

I understand what you mean as the cafcass officer said the say,
"how he puts him self across"
so the court route is the option again then,
think am going to phone cafcass, and see what they have to say, as the solictors around here just want a case then to milk it, and arnt really bothered about the out come...0 -

That was my thought too.
The grass is always greener till your living there.

I havnt spoken to the PWC for 2 years she wont speak to me, after taking her to court. and ive heard with my own ears the way she speaks to him on the phone let alone at home, and ive seen the text messages she has sent him with threats If he wants to see me out of the arranged times and days.
and when he says with me for 3 weeks in the school hols, 2 days before he goes home his mood changes, and its not nice to see he isnt happy to go to the PWC..0
