breach of data protection???

so i changed my account to santander i am thinking this is a mistake

i got sent a letter confirming which of my direct debits & standing orders had been sucessfully switched and which hadnt , however the envelop hadnt even been folded over and sealed

is this a breach in data protection?
the letter had my name, address, account number with them , reference number with them and all the names of the companies i make paymets too.

so i wrote a complaint e-mail and got a cbk

the on the call back the complaints advisor left me a voice mail which pretty much said 'i am trying to contact u in regards to your recent complaints e-mail you sent to santander aabout a breach in data protection please call me back'

the fact a mssg was left acknowledging i had an account with them which was under a complaint isnt this yet another breach?

just wanted to double check before i phone them

    Leaving you a message, they didn't supply any account details, so no, this is not a DPA breach. As for the unsealed envelope, all I imagine you will get is an apology IMO. The worst you can do is report them to the Information Commissioner.

  • thanks its just a worry that any one could of seen my details
    i have cancled my card but it doesnt seem very professional - not being able to seal an envelope from what i have read on here its a sign of things to come

  • I don't understand. You switched to Santander knowing they had bad customer service. And you are complaining at bad customer service?

    To be honest, it's pretty easy for an envelope to go unsealed. Our office has a large machine which stuffs and seals envelopes and if it runs out of water or malfunctions - the envelope goes unsealed. It's really not that big of a deal. It went from branch to postie to you. I'm sure your postie doesn't really care that you're with British Gas.

    I've got a feeling that you're complaining for the sake of complaining.

  • Oh no! I receive post through my door with my name and address emblazoned all over the front of the envelope -is this in breach of my privacy too?! Some of them even have the senders address on the back!
    Am I right in complaining to whomever sends these envelopes that they are in breach of the Data Protection Act?

    You are barking up the wrong tree.

    The only people who would have tampered with your account are Santander. And I know that any bank worker who is caught accessing someone else's account without permission is sacked on a charge of gross misconduct meaning they can't work in the industry again.

    The Postal Services Act 2000 means it an offence for any postal worker to tamper with the mail in transit. This means from the time Santander gives them the letter until it reaches your address no-one can tamper with it. Royal Mail delivered the post to your address so it's clear they didn't.

    So that leaves the people in your household. If you don't trust them then maybe you should not live with them.
    I'm not cynical I'm realistic :p

  • firstly i didnt switch to santander knowing that they were consider to be a bad bank, i switched because i couldnt stay with my current bank

    secondly i was unaware it was a machine that seals envelopes
    this had never been sealed in the 1st place for any one in my house hold to open it the flap had never been folded and the gum unused

    and i am not complaining for the sake of complaing, i consider the information in the letter privet
