Official receiver lied to us-wife in tears!!

Hello

We went bankrupt 3 weeks ago.

We both had official receiver interviews, it was on tuesday. At the end of the interview the woman told us we would NOT have to pay any money per month as i was on low income and my wife is on benefits. This came as a great relief.

Tonight we came home to a letter twlling me i have to pay £143 a month!!!!! Obviously its friday night so office ia not bloody open! My wife is in tears, been sick and shaking (she suffers severe anxiety and depression!!)

We cant afford this! This woman told me we didnt have to pay anything!!!

What can we do, my wife will struggle to get through the weekend, im
Not exagerating! She cant dwal with stress like this!

I feel ssoooo angry at this woman and this letter!!! :(

    oh i'm sorry to hear this....did she go through your SOA in the interview? did she say your expenses were acceptable? this could well be a mistake... why do these kind of letters always come through on a Friday? x

    have a read of the letter or agreement they sent you, does it say that the payments are due to a change in you tax code

    On your SOA, do you state that you currently pay £143 a month in tax?

    She went through everything. Then told us nothing would have to be paid! Im angry and my wifes upset! Why oh why play with our emotions like this! Its not fair.
    My wifes cried herself to sleep with worry, shes in bed and told me she doesnt want to wake up while monday so it can be dealt with!!
    I feel bloody useless.
    For those that think bankruptcy is an easy way out i wish they knew!!!!

    Check how much you stated on the forms you paid in tax and then post back if it's the same amount. If it is, we can put your mind at rest.

    Whats an soa? All i have paperwork wise is the petition form we filled in prior to bankruptcy.
    The letter says something about going onto a NT tax code so my wages will go up.
    So does that mean my wages will go up by £143, which i then pass over the official receiver? If it does then ok. but what about my working tax £211.10 working tax credit?

    Yes, basically the £143 pm that you normally pay in tax will be in your wage instead, you then pay the OR with this money, it is simply the money going to the OR instead of HMRC, It shouldnt affect your tax credits at all

    OK, if the paperwork mentions that it relates to tax then do not worry - it is fine.

    HMRC will change your tax code so that you no longer pay tax (until the end of this tax year), so you will receive an extra £143 in your take home pay. You then have to pay this amount over to the OR.

    I'll pop back in a minute with a link with more details - but you can tell your wife the good news.

    SOA - is Statement of Affairs, the paperwork you filed at court.
