CRB and occassional helper forms

I am not sure if this is in the right place but I'm sure a nice mod will move it if necessary:o

I have a friend (honestly) who is an elderly man who has been quite poorly over the last year, this resulted in some confusion and forgetfullness.
About 10 months ago he was shopping in the supermarket, left the supermarket and got stopped in the car park and asked to produce his receipt, he couldn't find the receipt (he'd popped it in the trolley with the shopping and it must've blown away) he was ultimately charged with shop lifting (all of £25). The solicitor advised him to opt for Crown Court as the was positive the jury would find him not guilty but that it could take up to a year, my friend just couldn't face the wait and the stress so went to Magistrates court and 'to get it over with' pleaded guilty! He got a fine.
He plays a musical instrument and plays for a drama group for their shows once a year, the cast has under 18's so he has been asked to fill in an 'ocassional helper' form. He's now mortified that this conviction will come out on the form and that the group will ask him to leave.
Can anyone tell me if this will come out on this form?

  • Yes it will. The innocent should never plead guilty! He will not be able to do anything with young people for a very long time. Should have listened to his solicitor.

    The OP says that the elderly person is confused and forgetful....why are you telling us this when you are saying that he didnt actually shoplift ?

    Then , to the receipt.....ok , if as you say the receipt blew out of the trolley , is that any excuse for admitting to a crime if you didnt actually do it ?

    I know if it were me and i had genuinely bought something , lost the receipt and then within mins been accused of stealing it , i would be kicking up stink !!!!

    I would be back into the shop and demanding that each and every copy till roll receipt was checked as the copy of the sale would be on there , i would stand by until they checked every single cashiers till !

    This would have proved the innocence of the person accused immediately !

    OP , why didnt your friend insist on this being done?

    He is elderly and gets confused easily, he didn't understand why he was stopped, why he was taken to the police station and why he was charged; I would think the furthest thing from his mind was the fact that till rolls could be checked! The solicitor tried to tell him that there really wasn't much of a case but in the week between the charge and the court case he was so worried and stressed that it was making him ill, he couldn't see past the stress and the fact that it was making him ill so against all advice he did what he thought was the only thing to make it all go away!
    I hope that you never grow old and confused.

  • It seems that the supermarket he used had the tills to the right and the 'homeware' section was in front of the door, he went through the till, paid then as he passed the homeware section on the way out saw something and ducked down the aisle to take a look meaning he walked out of the homeware aisle straight out of the store, he packs his stuff into bags into the car boot so everything was loose in the trolley. He's seemingly shoved the receipt on top of the trolley and it blew away when he left the shop.

    I know, I know just typing it I can see what he's done but he really never even thought. It does seem a crying shame that an elderly man who's worked so hard all his life makes a silly mistake and it's going to effect the rest of the life he has left.
    He doesn't work every week with the drama group, just plays for the production.

    Its unikey it will stop him as it wasn't a crime against a vunerable person (child/adult). The gentleman should however disclose the issue on the CRB form.

    As he has not committed a crime against another person i would think it is unlikely that they will stop him helping out, especially if he is someone they have known for many years, if the crime was against another person that would be different, i think he should tell them what happened as it will come out on the form, they will probably be understanding as if he does get confused at times someone there will probably have noticed this

    So elderly and confused but still manages to go out shopping alone ? So elderly and confused that he manages to play a musical instrument in concerts etc.......

    Yip , when my time comes to be "elderly and confused" i wana be just like your friend !

    P.s please dont preach to me about elderly people who are confused....my nan is in the throws of dementia and if you saw her you would know what confused really means....(maybe thats why we never allow her to go shopping alone;))

    it shouldn't stop him working with the drama group, but for obvious reasons he will not be able to have anything to do with the groups finances ... however, for an innocent person, however elderly & confused, to admit guilt AND pay a fine, you have to ask whether they were actually guilty ...
