From my own personal experience with a union, I found them worse than useless, although to be fair it could have been the people rather than the union, if you see what I mean.

I would certainly see if you can get legal assistance - the threat of legal action often works wonderfully to get people to act, rather than brushing it under the carpet, which is what seems to have happened in this case.

As an aside, it appears that he has virtually admitted that he did do it, but wasn't aware of it (if I read things right), so as others have said, surely as he was in an aroused state he would have been totally aware? A question for the male members (sorry.. :)) of the HR department.... Also, as you said it is a large multi-national, you should be able to take things higher and higher if you feel that you have a grievance...

The comment by a poster about - to be fair, it might have been the people rather than the Union they represented at fault - hence my thoughts about wondering whether your Union has a Womens Officer - if it does then she might take it as a very "personal" thing precisely to help you.

I have deleted a quote from Gwen80 here at her request - without it my post will make less sense.

This is getting more farcical with every new post!

Is continuing this thread really going to achieve anything (further)?

Yes it is - support for Gwen.

Which - incidentally - I suggest you could best do right now by removing that quote from Gwen you have just put. How is she supposed to remove those "identifier" factors - with your quote there from her? Hence why I didnt put it up myself - because I AM trying to help.

Good luck Gwen, just popping my head round the door to let you know I'm silently supporting you and hope you can find a decent resolution to this matter.

I would also advocate joining a Union.

Sorry, there large parts of this thread that I didn't get to read, so I apologise for going over old ground, but what are you appealing against? I assumed the disciplinary hearings hadn't been concluded yet.

What would happen if he joined the Union? Would he be able to being management?

What a waste of time and energy! Why spend time typing out a long response, when you haven't bothered to read the thread to see what the current issues are?

Hugo, your views would have been apposite had you posted them at the time of the opening post, but the situation has moved on considerably since then, and although OP did report the incident, the outcome has not been as you predict. Now if you have some TU advice as to how to deal with the current situation, or more specifically can answer the union question which has just been posed - ie would a union represent Gwen in respect of this if she joined tomorrow - that would be worth reading.

There's nothing wrong with a bit of manners now is there. Please don't come across like you're better than other people - it's actually very ugly in someone who's obviously very bright. Your second paragraph on it's own without the last phrase would have sufficed. The first para was just uneccesarily and condescending.

Although you are right, I didn't read the whole thread. It was silly o clock in the morning and I'm having trouble sleeping at the moment so I admit I did ramble on a bit.

TUs cannot refuse members. So if Gwen wanted to join she can. TU's are also quite keen to combat sexual harrassment in the workplace. Thirdly, in my experience TUs don't draw the line under any pre existing issues, unlike for example insurance policies against legal action etc

So I would advise her to join if she want's to.

EDIT: Some TUs have a rule in their consitution that tries to avoid actually going out of pocket for members who've just joined, this is to stop the mad rush to join and take advantage of thei facilities in the case of mass redundancy etc. However in your position I would join anyway Gwen, You should be able to seek support from a TU rep. If that is your boss then he may refer it to another rep.

As has been said though, you may be surprised to find out how many people are actually on your side. On a positive light this guy has now come up on the radar, and HR will now be watching him. Your 'offence' will be seen more as a one off.

I think you have a very good case for making sure that the two of you don't work together anymore.

    Good luck with your appeal

Hello Gwen, I am sorry to hear that your grievance did not have the outcome you were looking for.

You've had some good advice about joining a union. My experience is that some unions will not assist with a matter that was already on-going at the date of joining, but that's not the same for all unions. Either way, it could still be a good idea to join, in case you have further problems with this person.

You might also consider giving the EHRC helpline a ring. They give advice on discrimination matters, including harassment in the workplace. They may be able to give you useful advice about conducting the appeal.

    Hi Gwen

I haven't posted in here before now as I had nothing to add which was helpful, but now just want to add my support for you. I have no idea what Miss D is playing at - she's either a troll or actually quite ill; I'm unsure which.

Whilst Miss D is entitled to post her opinion, calling you the names she has, and saying she hopes you'll get what you deserve is vindictive. Clearly her apology the other day for 'going too far' (for which I respected her) meant nothing.

Put her on ignore then you won't have to read it.

If you need an opinion on your appeal, dare I suggest you PM SarEl who may be able to give you a couple of pointers (or even recommend a solicitor)? She was very helpful to me in the past.

I wish you all the best. :)
