Options
sky engineers caused some damage to my property.

they damaged my new vinyl floor when they slung there tool box down and it cut it and dented in in few places, 4 months later sky want to sort the matter.
they asked me to send off some quotes to replace it,which has been done and were emailed over to lady dealing with it.
she called today to say they are fine and will cover the full cost of replacement.
so i was like wicked finally sorted, can finally get the dealt with and on with everything.

but after about 6-8 hours sky phoned me back and said sorry we cant do it. and i want be sending a cheque out

question i ask is this.

can they make the offer to me and then refuse it?
they emailed me and said they will make payment by cheque to me, can this stand up if i have to go legal

No its not legally binding, however, will only help you in the long run.

Send a recorded letter to Sky giving a breakdown and clear total of costs, including quotes, give 10 days to receive payment stating you will commence recover in county court if none arrives, and do so.

If they damaged your property they need to fix, its not complicated.

    Job done.
  • they have had qoutes, and said they would pay basically admitting liability if they made the offer.

but they have retracted the offer.

i have given them 7 days to sort. i have emailed the pics of damage aswell.

if they dont sort with in 7 days i will take to court

They may say they have new information that shows it wasn't there fault, who knows.

You need to give the court proof that you have done everything you can to solve this, 7 days at Xmas to actually fix anything is a little short.

Cant start action untill a clear notice before action being sent.
Do you have any legal assistance with your home insurance?

    Daz,

Correct me if I'm wrong but did you say that it was AVS who did the install/damage?

If so you might find that when Sky contacted AVS,they have denied the whole thing & therefore Sky have now said no. (I saw this happen when I worked for one of Sky's contractors)
Sky may also try to dodge the bullet by saying your issue is with AVS & not them.

avs is the company who caused issue, and they sent the person who caused issue out to assess it lol

avs have refused to pay, we have been there but sky have opened the claim up as avs sent the guy out who caused damage, and sky want to deal with the claim to sort matter out asap.

they already made the offer and have email from sky relations saying theyll pay me it by cheque and wanted to know the perosn they should make it payeble to

It is Sky you need to take action against any letters to AVC wont be much use to you, you need records of all comms with Sky not AVC, hopefully the courts will see 7days at Xmas as acceptable notice before action.
