Any advice please

Hi can anyone advise me please, Ordered a Blackberry PAYG from Dialaphone last night, checked the account on Dialaphone to see status update and it was saying ATP failed so checked my card balance online and payment has been taken.Decided to phone to see what was going on as delivery was arranged for tomorrow. After finally getting through and speaking to someone i have been advised that the phone was not in stock  (when i ordered it it was showing as in stock) and that they will send it when the stocks in  explained it was a christmas present for my daughter and that if it wasn't in stock i wouldn't have ordered it. Asked why they have taken my money when it states on their website
"We only take payment for your order when it is despatched from our warehouse. If the despatch of your order is delayed because of problems gaining authorisation for payment or for any other reason, you will be notified by email or phone". Have not recieved any email on the status of my order, the girl i was speaking to said she didn't know and that she would look into it further and call me back..... asked her would it be today and after a short silence said oh yeah of course, still waiting for a call back  If payment is showing as pending could i cancel it through my CC company? So annoyed  with them!!!! If it is not in stock can i cancel that order and how long would i have to wait for my payment to be put back on my card.
Some of this might sound like stupid questions "Sorry" :embarasse but any advice would be appreciated Thanks :)

  • Ring them up and state that you ordered in good faith on the understanding that the phone was in stock. Tell them that as their website was not showing the correct information you would like to cancel the order so that you are free to look elsewhere for the product. If the robot who answers the phone isn't helpful then demand to speak to a manager. I don't see why you shouldn't be able to cancel the order, given the circumstances.
If I've helped you please show your appreciation by using the "Thanks" button
