Relationship break up - property owned as joint tenants

    As long as she remains a joint owner, she has rights to occupy the property, so that is one thing to consider. At the moment, she's moved out and is agitating for more money than she has contributed and is trying to persuade you to sell. Perhaps once she realises that she can't force you to sell, only a court can, she may try to agitate for more money by moving back in!

    ok thanks so assuming i reside solely in the property, and pay for 100% of the mortgage/household bills, how would a court see this if it came to selling the property?

  • Can't say but I think it's really, really unlikely that your ex would go to the effort and expense of taking this to court. If she lost her claim she'd have to pay for her own costs and yours. so that's a real incentive to be reasonable and find a mutual solution.

    I can't see that she's got a case to claim for anything and can only assume that she's either woefully misinformed about any possible equity or vindictive.

    Your situations sounds potentially nasty, expensive, time consuming and you really need to see a solicitor on this matter. Though try and avoid costly legal stuff if possible. Also tenants in common is not always a 50/50 split. For example I was in a similar situation as you a few years ago i.e. tenants in common with I recall a 78/22 split in my favour and the mortgage repayments 50/50. As it happened ex GF was happy to walk away without a pay out, though she did ask and I declined as house needed money (and still does) spending on it. I also explained that with a repayment mortgage interest payments are largely front loaded and there is no equity to share out especially as she !!!!!!ed of after 8 months. My sole expenses were getting her of the mortgage & land registry.
