Husband maybe dismissed from work-advice please

Hi, I'm posting on here because on Wednesday my DH was suspended from work because they think he has been poaching work on the side-he hasn't and they have no real proof he has and he will fight via tribunal but it leaves us in a scary situation. If the worse case scenario happens and he is dismissed that leaves us immediately without his wage. i work 30 hours a week and we have two children one who is at school and my DD who is almost 2 who currently is in childcare 3 days a week. If he is dismissed can i now claim tax credits/working tax credits-we don't get tax credits at the moment but if his wage goes we will just have my wage coming in-I earn £21,000 a year plus shift payments on top. Any advice would be greatly appreciated-I'm hoping it doesn't come to the worst but I need to be prepared to put a plan of action in place as I don't want to lose our house/not be able to pay the bills. We have already had to take all the christmas presents we have bought back (except toys for nieces and nephews and our kids) and explain to people to please not buy us anything this year as we cannot reciprocate-I feel dreadful but have no other option with our now uncertain future. Can DH claim jobseekers allowance if he is dismissed? Thanks in advance.

  • i too am going through a unfair dismissal claim.

    do not try claiming anything if your husband is still being paid while investigations continue. the benefits will be harsh in the future, which would ruin your life more.

    dont try claiming yet. wait till judgement/ his wages stop coming in.

    they have to give notice of holding payments/wages or dismissing him. use those the day he receives the notice to then claim benefits. even if company accounts say dismissal date (imaginary 20th december) and last wage slip in bank about (27th december) you can apply on the 20th.

    has he already been 'dismissed' meaning his employment contract has ended and no more wages will be paid?

    use the entitledto.com website to give you an idea of entitlements by typing in the worse case scenario finances.

    i have it where JSA sanctioned me because they have deemed my employment ending voluntarily as exboss didnt want to admit the true cause, to avoid there being further evidence i could use in a constructive dismissal case against them.

    HB then said because my finances were unclear, what benefits i am on, will be on in the next week/soon they put a hold on HB until JSA appeal/tribunal result.

    i hate benefits. sooo much.. but dont claim them too early or just 1 week too early can mess up your finances for weeks/months.

    got any more info on when things happening with your husband.

    plus a bonus. well not a true positive but to make a good situation out of a bad one. if husband is laid off he will be able to look after kids saving a bit of money
  • I'm a little confused. If Hubby loses his job the family income will still be £21,000 + shift payments!!! And you are worrying about not making ends meet - looking to claim benefits with only two children. Hey you must be having a laff!!

    I honestly don't think that you will get very much on that large wage!!

    There are many families with a couple of kids on here that have to manage on less than 1/2 of that and cope quite well.

    I would seriously look at you outgoings and reduce them first. Debts can be paid at £1 per month for each one. You should look to pay your mortgage first and anything else last!!
  • i've had a pint or two so bear with me....you work 30 hours a week so could you not tell the tax credits (if your husband is sacked) that you are the main earner and go from there? if you claim child care there would be no need as he would do it...job solved really....
  • Thank you mitch-sorry you have had a rough time recently. Not going to try to claim anything until we have confimation of his last paid day but need to get info together to stop myself going mad! He's not been dismissed yet-he is under 'investigation' but have heard that bosses have trawled through his emails and not found a thing and have asked clients if he has approached them and all of course have said no. however need to know that we are going to manage...

  • Thanks oldestrocker-I know we have been very lucky in the past and i know I earn a good wage.. however I work bloody hard for it-nights etc. We both work very hard and dh has managed to complete a masters degree despite leaving school at 16-we are grafters and have never claimed benefits before. however, we have a fairly large mortgage that we could afford and have now been put in a horrendous posiion where we could lose our house which is near the school my DS goes to. You CAN get tax credit whilst on my wage and forgive me that I don't want to lose my house but after paying my taxes and claiming no benefits for many year when the sh**t hits the fan and we can't afford to pay any bills then god help me i will fight tooth and nail to keep life the same for my kids-sorry.Don't judge me please-you don't know me and I have asked for advice not judgement.

  • Plus I'm not bloody proud and will live on smart price beans to get us through this but a loss of the m ain breadwinners wages all at once is a big hit.   • They have no cast iron reason-he has never approached this company's customers to get work on the side. They've trawled his emails and found no evidence but when his clients are ringing the company they are telling them he no longer works there :{ despite the fact he hasn't even had a disciplinery yet. Still reeling from the nasty message that was left for me by oldestrocker...am i 'having a laff'-unfortunaly it really doesnt feel like it when everything that I have worked bloody hard for is going to be taken from me..

    you get to much for wtc the cut off for a couple with children is about £18k ish.

    Unless you are both working. I don't believe you can claim the child care tax credits.

    You will not qualify for any means tested benefits such as council tax etc.

    child tax credits would be min. Normally it is based on last years income. I would not mess with it as you could end up with an over payment.
