Christmas bank holiday - days off

hi there the Mon/Tues after christmas and Mon after new year are all bank holidays as you will know. I work only 2 days a week - Thurs and Fri. What allowance would you think I would be eligible for in terms of any extra days off in lieu? I am given an extra 2 days' leave each year to compensate for the 4 bH mondays that I miss out on (in theory). thanks for any advice.

  • Why would you be eligiable for anything? The proper days of the bank holidays are sat and sunday but obviously this has been moved to the Monday and Tuesday as most people do not work the weekend but neither are on your working days.

    As long as you get pro rata the correct number of days of in a year I don't see why you should get anything extra.

    You should as a minimum get 2/5ths of 5.6 weeks which works out about 11.2 days. How much holiday do you get now?

    You work Thursday and Friday, those are normal working days. Monday & Tuesday are bank holidays, and you're not working those either, so why would you get any time off in lieu?

    Wouldn't you normally get time off in lieu if you were working the bank holidays?

    They might be bank holidays for a lot of people but in fact are 'substitute' days and employers do not have to grant them.
    direct.gov is the site to check.
    If you normally work Thurs/Fri then no, you are not entitled to anything extra just because the rest of the workforce who DO work those days may have them off.

    I get 12 days' leave a year. My job-share who works the other 3 dayshas added extra days to her leave when christmas day has fallen on a day she wouldn't normally work. I'm not sure whether this has been sanctioned or not. I'll ask the question and see what happens.

    going by some the the replies it would follow that people who work mon to fri and not weekends should also not be eligible to 3 extra days off as they wouldn't normally be working these days, ie sat and sun, either
  • This can't really be answered unless we know the wording in your contract in relation to holidays/annual leave.

    In terms of employment law, you are not 'entitled' to anything extra.

    If you're working on the bank holidays, you'll be entitled to the time off in lieu.

    If you're not working on the bank holidays, you're not entitled to time off in lieu.

    You're not, so you're not entitled to TOIL.

    but the bank holidays could just as easily have been Thursday and Friday? Seems very arbitrary to me. i get 12 days total leave including my allowance for bank holidays made up of 10 days (pro rata for the 5 weeks annual leave for full timers) and 2 days in lieu of bank holidays so obviously my employers recognises my entitlement to bank holidays even when they fall on a Monday

    don't think my contract is specific about holiday entitlement - I think I was the first job-share in this company. I seem to remember it just refers to company leave entitlement which is 25 days plus usual bank holidays
