Mortgage shortfall from 1995

I'm new to this forum but it looks like its just what I need for help. I received a debt letter for a mortgage I had in 1995-6. I now have a pub which is how they found me I think but the debt is over 10 years old. I did change my name after I moved due to a violent relationship and I think that is why they couldnt find me. Will this affect the debt? Also I'm currently waiting to hear about my credit report to see if a CCJ was issued at any time against me.. I ve not replied to this letter as yet and urgently need advice as I dont want to lose my pub or my livelyhood due to this debt. Its for £37,500 as they had to sell the house at auction and it didnt redeem full price.. HELP!!!!!!

Mortgages are a bit different I think - you could go post on the Mortages board for advice or call a debt advice organisation like National Debtline or Citizens Advice.Debt at highest: £8k. Debt Free 31/12/2009. Original MFD May 2036, MF Dec 2018.0 -
As Katsu says, with a mortgage shortfall the relevant time period is 12years rather than 6. Aside from that there is some info here - http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=11_mortgage_shortfalls its quite complex in terms of mortgage shortfalls as to whether they can charge interest etc (if its not statute barred), might be worth calling national debtline for some advice. But do find out if there is a CCJ and if so when it was granted first.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

I'm new to this so bear with me..Ive recently recieved a debt letter from a shortfall in my mortgage which was taken out in 1991 and i still owed the money when i vacated the property in 1995. They have just found me as i changed my name after moving out of the house due to a violent partner and have never goneback to my own name until 3 years ago. I now have a pub and havebeen sent this letter asking for the debt to be paid back £37,000!!! Where do I stand please help!!0

I have recieved a demand for payment from rbs from a mortgage i too out in 1991. The house was repossessed and i apparently owe £37000.00!!!!!! What do i do help please:eek:0

Well the deadline for chasing a secured debt is 12 years. Have you paid anything since 1997?If you've have not made a mistake, you've made nothing0

When was the house repossessed and did you pay anything following this? There is a statute of limitations of 12 years on mortgages - whether or not they have taken out a CCJ however could be a different matter altogether...DFW Nerd #025DFW no more! Ive payed nothing at all since imoved out.Ive just received an experian credit search and dont appear to have a ccj on this account. What is the proceedure do i write to them or ignore them??? Im stuck!!0

Firstly, you are not stuck. You do need to do some more digging before you respond to RBS.
Can you check if any CCj was taken out prior to 2004 on the Registry Trust online web-site. it cost £8 per search.If you've have not made a mistake, you've made nothing0
