In any civil matter, such as this, it is for the claimant to prove that the other side has committed some wrong. Although writing to them is a very natural reaction such letters inevitably provide information that they would not otherwise have and makes their job easier. Many here - and elsewhere - will argue that the claims such private parking companies make are at best debatable and the fact that so very few cases are ever taken to court bears this out, IMO.

You have latched on to the fact that this is a bluffing game. The average PPC's business model is predicated on the basis that sufficient people will pay up on receiving a ticket/claim letter that there is no need to pursue those who duck payment as to do so is time consuming, comparatively costly and is not without risk. This is, in my opinion, the crux of the whole PPC issue and supports the argument that they are less interested in upholding the legalities and far more concerned with securing a profit. For them to suggest - as is frequently done - that they are merely applying a business test as to which cases they pursue is surely an admission that they are interested in profit.

Do not be tempted to be drawn it. You are under no obligation to respond to them whatsoever - despite some of the claims they and their debt collectors friends will make. Sit tight and in the extremely unlikely event that you find yourself looking at a court claim come back here for guidance and support. Look at the first topic at the start of this sub-forum as this will give you an insight into to the type of letters you are likely to receive.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

    To quote Martin Lewis directly:

'These supposed 'fines' are the new Wild West, and whether the cowboys do it at supermarkets, retail parks, hospitals or housing estates, they're often unenforceable.'

Just to add, the tickets are always unenforceable, see my signature below.
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

Ok i get the message THANKS. its all a bluffing game then i just thought if i sent them my letter it would pre empt any further action plus i could charge them a fee for my time.scare them back maybe.
Instead of pre-empting anything all a letter does is to say to them "we have got through to someone who is uncertain of their ground, lets pester him more and he might give in". By ignoring them they do not know who they have sent the invoice to-you could be a top notch barrister.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

You cant just ignore them as this creates dis honer by non compliance. Its best to conditionally accept and just pay them the original parking fee and staying out of a controversy. Apparently by telling them this they cannot take it to a court and then send bailiffs. Read the original post.

Do you work for these people. Or some company similar.

OP completely ignore this poster, he is talking utter nonsense.

i only want to get this right as my dads an oap and thought is blue badge covered him at netto allso.

Err, the Blue Badge scheme does not apply on private property. Go read the supporting info that came with his badge or check it out online.

As for the rest of the advice, it is good - Simply ignore them totally.

steve1time please except the advice as its given your case is no different to thousands on here.

Your quoted term could be used against your Dad if he entered a fair and binding contract, I very much doubt that he did.

Your best option is to ignore them.

    Trethowans? Probably CP Plus then?

If so, doesn't matter what you say since they never have and never will do court.
