Just had doorstep caller!!!!!

Good morning, feel better today. My DH complained to the police last night about how I was treated and to be fair, they were really good and have listened to the tapes, and will 'deal with this at a local level'. I then spoke to another officer who was really nice and he explained about civil trespass and what rights I do/don't have (although tbh i think i knew as much as him cos of this site!!).
I have been quite down about the br process lately and last night just seemed to top it off. However, in some strange way it has made me realise that I am not a 'victim' and shouldn't feel as such. I am a bankrupt and I know my rights. I am going to write to the DCA just with his BR certificate and advise I have contacted the police. I will also advise the OR. Then I am going to forget it, get on with my life and enjoy the wonderful family that I am lucky enough to have (oh, and make sure I always double lock the door just in case
)
Thank you all so much for your comments and helping me realise that I AM RIGHT

Personally, I agree with DD. Let it go. It would be your word against his anyway.
I'm not playing down the 'wrongness' of it though. It was totally out of order.
Try and let it go I know it is not easy but they are just scum and need to be treated as such why waste the time of day, the police are out of order but if you have ever watched the bailiffs on the tele you will know that they do not know anything about your rights as a debtor, in on case a lady was forced to pay or hand over goods which belonged to her for dept in her sons name, the police said oh well you will have to do what they say. Just try ad put it behind youIf you woke up this morning congratulations, you have another chance :j0 -
If you want to send a letter, try this one by Fermi. Obviously adapt it slightly for your needs. Send it recorded.Your AddressDate:
Creditors Address.
NOTICE: Pursuit of a debt included in a bankruptcy. Do not ignore this letter. You must cease collection activity IMMEDIATELY.
Dear Sir/Madam
Account No: 4563210025897412
You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
I would point out that the account was included in my bankruptcy which commenced on <date>.
Consequently, the debt in question is no longer my legal responsibility.
ALL contacts and claims regarding the debt MUST be addressed to the Official Receiver's Office dealing with the case.
My case was XXX of 200X, at <somewhere> County Court, and the address of the Official Receiver is below.
<Address of the OR.>
A copy of the bankruptcy order is enclosed for your convenience.
Please note that the Official Receiver has requested that all future contact from your company regarding these accounts is reported and forwarded to themselves, and that continued contact with myself may result in Official Receiver taking enforcement actions against your organisation.
Please also note that we are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when the debt is not due.
In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.
This type of debt collection method is contrary to the Consumer Protection from Unfair Trading Regulations 2008, in that it is intended to cause alarm and distress to the recipient.
Your methods will not be tolerated.
A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
We await your written confirmation that this matter is now closed.
We look forward to your reply.
Yours faithfully

Hi Michelle - you need to be in a forum area not a thread firstly - so right near the top of the page if you click bankruptcy and living with it it will take you to a list of all threads in this area - there is then a button that says forum tools (it's just above the list of all the threads) - if you click on that it gives you the option to start a new thread.
I hope that makes sense. If not post back and someone else can try and explain.

I have just phoned the police and basically been told that the dca has a right to enter my property and i need to contact the company and get them to stop contacting me :mad:
I argued with the girl saying that was for baillifs and not DCas so she is getting an offcirto call me back.
God, i am sitting here in tears now feeling so degraded wondering why the hell i even bothered.
She even said 'what do you want us to do? we don't log enquiries' so i said I want them not to come back again and have it logged so she said 'speak to the company'.
God, i am so mad

The last thing you need this side of xmas is a loony coming into YOUR home without permission. Not only are you trying to get yourself back on track after huge financial termoil, but he had no right what so ever to barge his way in. Ive been through BR myself, all be it numerous years ago, and had similar issues with so called debt collection agencies. The trouble with them is the debtors files are sold between them at such a fast rate that information gets missed and your file may not be updated to say you are now BR. You probably do need to give them a call and advise them, they will probably get stroppy and ask for a copy of letter from the court to prove you are bankrupt. Sorry to put a downer on it, but they will probably drop the file like a lead weight and sell it on, so you may get someone else try their luck.
Keep strong, head up. BR is not an easy option, but you will acheive a better quality of life from going through it and you will come out the other side. Dont let it get you down, youve come this far and in the grand scheme of things is it really worth it? He probably works commission and you had the last laugh by throwing him out in the snow!
All the best.
