Just had doorstep caller!!!!!

Hi all,

not been about much recently. Am finding the br process quite overwhelming at the mo (3 months in) but have been lurking and posting now and again...

Anyway, about 10 mins ago I got a knock at the door, answered it (not scared now you know ;)) and there was this old man who asked if this was 'house name' and I said 'yes' and he said 'ooh, it's cold out here, can I just come in' and he pushed past me into the kitchen!:mad: I then saw his slip of paper and said carphone warehouse (a debt inc in BR) so immediately said no you cannot, get out of my house and pushed him out the door.

He did go out and asked for my husband, who was at work, and i said there is no point cos he went bankrupt on 26th August so you cannot chase that debt. He asked what he needed to do now and I said nothing because we don't need to speak to you. He then left.

My worry now is that he has stepped over my threshold, does this give him any rights? I think not but just wanted to check.

Am going to write to the DCA (CARS) again and advise them of BR, must be a draft letter I can find on here somewhere. Am also going to contact RTLU.

Surely this is harrassment. DH wants me to call the police but this is a small town and I see the PCs around town so want to avoid them knowing my money worries (daft i know).

Sorry to rant but am absolutely fuming. My 5 and 3 year old were up with me when he came. Luckily I managed to smooth it over but I don't want them worrying about stuff.

God, when will this end!!!!!

And, btw, the amount owed was £97

Going to calm down now.........

your caller had absolutely NO right of entry.

Do not write any more.....don't even bother yourselves about it all.....

call the police, make a complaint against this man...if you know his name.

Even if nothing is done by the Police, at least you have logged the complaint....and if it happens again, you have evidence to pursue matters further.

The Police need no know anything about your BR..it is irrelevant to the complaint.

Even if they do find out....so what?

Inform your OR of what has happened....perhaps this company don't actually yet know of the BR?

If that is the case, it is still not your responsibility to inform them.

Time to fit a chain on your door?

Not because of people pursuing a supposed debt...but because it might not be the person you expect next time?

Nobody can knock on your door and then enter your property without your permission. His behaviour was completely out of order. Do phone the police and report him. If you dont he will continue to treat people like this.

I have just phoned the police and basically been told that the dca has a right to enter my property and i need to contact the company and get them to stop contacting me :mad:

I argued with the girl saying that was for baillifs and not DCas so she is getting an offcirto call me back.

God, i am sitting here in tears now feeling so degraded wondering why the hell i even bothered.

She even said 'what do you want us to do? we don't log enquiries' so i said I want them not to come back again and have it logged so she said 'speak to the company'.

    God, i am so mad

    Hi,

Bankruptcy happened to get rid of this stress. Just let it go. The Police response was typical, they have generally no idea about DCAs or bailiffs. That guy will never be back again, don't let him spoil the 'peace' of bankruptcy.

I agree with everyone else....this sort of thing incenses me...grrrr!!!

Unfortunately most of the people who answer the phone at the Police Station are civvies - trained, but with no real knowledge of the law. Their job is often seen as 'fielding' enquiries or passing info on...

Don't let her ignorance upset you....you are in the right. This person shouldn't come around, let alone come in....and for such a small amount of money, too!!!

    Feel better soon xox

I'd get a snottogram together, and send it to the Inspector at your Police station... complaining of inaccurate information being given out under the auspices of the Local Constabulary.

It wont help your case...but it may prevent others getting this totally inaccurate information being passed as 'official'...

it might help if you mention that the 'proffering' of inaccurate information by the person fielding your request , does nothing but bring the Constabulary into disrepute.

BTW...when making a complaint, it is done face-to-face, a statement may need making, etc.

Phoning up and complaining doesn't actually achieve anything......

write to the Inspector complaining about the off-hand, incorrect treatment you received.

He had no right to do that. It's a good thing that you were able to push him out the door. If he comes again, it would be best to call the police because he has done it once and who knows what more he can do.

Personally, I agree with DD. Let it go. It would be your word against his anyway.

I'm not playing down the 'wrongness' of it though. It was totally out of order.
