shopped, Paid for it - but not in my bags?

Hi

I went shopping yesterday and bought a few items. At the tills there was no-one on the check out, so i queued at the kiosk like everyone else. While at the checkout a young man emptied the basket while scanning the items and I packed my own bags. When i got home i found a large item (xmas present) missing. On the receipt it shows the item and I have clearly paid for it but I do not remember the young man passing me the item to pack. I rang today and was told there is noting they can do and it happens all the time, and when i replied 'what does' she said that the next shopper take items that aren't theres. To cut a long story short I told them that i wanted to speak to the manager who wasn't there so i have made an appointment to see him tomorrow morning. I wondered if anyone knows where i stand with this. Am i entitled to my money back or another item??

  • Perhaps the store might have CCTV footage of you buying your items and leaving the one thing behind. We did something similar once at ASDA and they did give us the item we had left behind. Could be worth asking?

    Short answer is no unfortunately if it hasn't been handed in. Best you can hope for is the manager gives you a replacement as good will. Remain calm and be polite, that will give you the best chance.

    My mum once picked up an entire bag of shopping which wasn't hers. It was a complete mistake but she didn't realise until she got home. Not much that could be done by then. She rang the store and they told her to keep it as they would have to desytroy all the cold items anyway. Lucky for her the previous shopper had expensive tastes...

    What shop doesn't have a manger in? That is bs just trying to fob you off. It's unfortunately it is your word against theirs i don't really know what your rights are.

    In most stores the kiosk is the one place that will definately be covered by CCTV, it's well worth asking if someone can view that footage as with you having the till reciept it will literally take a few minutes for someone to check this as you have the timestamp for them to search, chances are if the cashier hasn't given you the item it will either have stayed at the kiosk for a while and then been putback on the shelf by a different staff member tidying up or a customer will have taken it, 9 times out of 10 from experience it tends to be someone cleaning the area that has moved it and it will just be a case of replacing the item for you.

    If it has been taken by another customer you have no right to a replacement.

    If at first they refuse to let you see the recording, you should then ask to speak to the manager and advise them that under UK law it is your legal right to be provided with a copy of the recording (They can charge up to £10 for this and must supply the recording within 40 days).

    I would avoid that as it will just prolong the situation, as i said i would ask them to check the CCTV and it could also be pointless to go down the legal route as they are only still obliged to give you a copy of you on the CCTV, if the item was left there for a while before it was picked up by someone else you still wouldn't see it being taken, at the minute you've just left an item behind which really isn't their problem, giving the manager extra paperwork and having to burn things to disc etc won't help speed things along.
