    [The advice I got minus personal details, I just need to get on and write the letter but maybe this advice will help you too]

    Based on the information you have provided the key legal points in response to your enquiry are as follows:

    I understand you ordered a DVD player from Media Promotions via a newspaper promotion. You have not received the goods and the trader is not responding when you contact them.
    I would advise that if you the trader is a UK company and you have contracted at a distance so via mail order, over the internet or telephone then your contract is governed by the Consumer Protection (Distance Selling) Regulations 2000. The regulations state that the contract has to be performed within 30 days unless parties agree otherwise and if it is not then it will automatically terminate and the consumer is entitled to a refund as soon as possible but no later than 30 days.

    If you have not already done so, write to the trader either by recorded delivery or with a certificate of posting outlining everything to date and make reference to the above regulations. You need to state you are now "making time of the essence" for the matter to be resolved within a set period of time (e.g. 14 working days). Make it very clear as to what is being claimed from the trader and it is also worth retaining copies of everything sent for your records.     If you have paid by credit card then the finance company can be held joint and severally liable within Section 75 of the Consumer Credit Act 1974 providing the purchase amount is over £100 and under £30,000. If you paid using a debit card and your debit card has a visa symbol on it then your bank may be able to offer a chargeback within the visa chargeback scheme however, this is only a scheme offered by visa and unfortunately, your bank have no legal obligation to assist you.

    I don't use twitter as I have never understood whether I would have to pay to get the messages on my phone.

    Hmm, wonder whether they'd be more inclined to resolve complaints if people tweeted them as it's more public.:think:

    im having the same problem, ordered pc tablet in november 2010. received 2 letters to say they were waiting for more stock it will be another 28 days, then nothing. tryed to phone them no answer and email them no replie, so emailed captaincash a few time and no replie. last week i gave it another go at ringing media promotions and got a answer maching saying if i bought anything from them through captaincash i needed to contact the news of the world then the phone num.i spoke to someone from the paper and was told to contact my bank to get refunded as promo med has gone into liquidation.i spoke to my bank which told me iv gone past the time i should of claimed. so iv lost out on £99.00 which i cant afford. can anyone tell me if there is anymore i can do to get my money back as this has been 8months now.
  • Hi all, I have heard zip from this terrible company since writing my claim back letters. I also spoke to my credit card who said it was outside the time. I've written to them to see if they will reconsider Supposedly the company went bankrupt?, but then a week or so I get a very similar looking promotion email to the kind sent before. This makes me really :mad: if it is them.

    How do all the people due their hard-earned money get it back?
