UNDERcharged by dealer
Bought a car from a local dealer and when it came to paying I'd paid by a combination of cheque and card. On the card amount they inputted the incorrect number and have UNDERcharged me by £1000.
My question is should they work out they have made an error (and they will) what is my position regarding this ? Is it a question of them having to write it off seeing as we shook hands, and driven off - seeing as I didn't notice it either at the time and wasn't responsible for the amount they put in the machine ?
Or am I legally liable still for the balance ?
Add into this the fact that upon driving home I noticed the windscreen had a chip in it, so I'm going to have to sort that out. Or can I use the £1000 shortfall as a barganing tool to get them to cover the windscreen cost ??

Say the car cost £7000 and you signed a contract saying you'll pay £7000 and only paid £6000 then you owe him £1000.
However it looks like you've purchased the car and he has technically offered it for £1000 less. Which means even though it is priced as £1000 more that is only an invitation to treat. You never accepted that particular offer, you agreed on the the amount which was £1000 less.
It's difficult to say but I doubt he could take it to court if anything happens unless you signed something.

The bill of sale which I signed was for the full amount but the till roll (i.e what they deducted) was out.

I think I'm right that most people will not ever notice but if a dealer rang up and say 'hey you have underpaid' then you will check the numbers and write the cheque.
I dont know if the 'all sales are final' rule applies here.0 -

You owe them £1000 its as simple as that.
I bought a car a while ago and the balance was due by cheque from me. They never asked me for it and i could have 'got away' without paying. My thinking was they would have twigged at month end, then i would have looked like i had been trying to pull a fast one, so i reminded them and paid them it.
Personally, i would pay them back while you still have the money available, bearing in mind that you will be expecting warranty work etc.
Also your insurance will cover the windscreen for maybe £50 tops with no risk to your no claims bonus.0 -

Doesn't matter, he signed off the full cost of the work. Whether he paid £6000 or 60p, he still owes whatever the balance is.
It's funny how we're all looking for loopholes to get out of paying our bills, but we're up in arms when the banks / credit card companies etc use the same tactics.Hope over Fear. #VoteYes0
