BT Broadband upgrade/new contract disconnection charges for broadband

I was contacted by BT in order to up grade my account. After a lengthy discussion I agreed after 3 years to move to a new Broadband option. I was advised on the 1st November 2010 that this was a new contract as they would send out a new BT Hub therefore I have a 14 day cooling off period. On the 3rd of November I found a better deal with TalkTalk so rang & cancelled BT however now they are charging me £130 cancellation fee.:(

Upset I spoke to an adviser who said it was an upgrade & therefore this is not a new contract & so there is no 14 day cooling off period to which I replyed if that is the case I have 3yrs with BT so I am not contracted to you & can leave without a change being applied, her manager then advised that this is a new contact but as the line was already activated that there is no 14 day cooling off peiod. Which is it? Where do I stand legally as I have completed 3 yrs with BT to be hit with a bill at the end when I have cancelled within 14 days so eitherway I have conpleated my contractual agreement. HELP:(

    You were certainly still in contract, you were just no longer in your minimum term contract (unless yours was an auto-renewing one). A cooling off period does not normally apply to an upgrade, although it is something of a grey area. However if you were told you had a 14 day cooling off period and can prove it, then you have a case for claiming the contract is void due to mis-selling.
    However if it keeps you out of the clutches of TT, it's probably worth staying (even with BT). Though there are much better options than both those companies.
