  • Many thanks, I will do that tomorrow first thing. Just a few more quick queries.
I already explained to the man that I have been paying £20 per month and that was news to him and he works for Baines and Ernst!
I was hoping to wait until I get (hopefully) the full amount of the money back. But he is demanding that I pay ASAP. So my question, can I cash this cheque and just refuse to pay a penny until I get the entire amount. After all, they are taking a 39% fee to assist me, yet before I have all my money they want thier fee. He wanted a min offer of £300. Can I just refuse to pay a penny until I get my full quota?
Again, thank you for the helpful advice. Its putting my mind slowly at ease.

Edit: I will get a bill too as you said, good thinking.

I would think you would be in your rights to get a bill and then if the bill takes the £20 a month off as well, then you will pay it. If you ring the fos and moj first and they say he has to send you a bill (they will also tell you if he can ask for money off your card now), then ring him and say what they have told you, that may shake him a little. I dont think they can demand money when they feel like it. They did you a job and on receipt of the bill you will pay.How can you pay a fee when you have not got the money yet to do it?.
  • Precisely. Thanks so much. I will phone tomorrow and keep you posted. :)

  • A Small update. I phoned the FOS and they said they can't help as they don't regulate the CAG but told me to ring MOJ. I did and the lady said that I needed contacts to go over, which I have none. They will phone me back sometime this week with some more information, but she never told me what they are doing is wrong. She said its down to the contract I signed. Is there a min amount of time for me to pay the bill? questions like that which I don't know. So im going to ring the CAG now to explain this situation. I'll keep you posted.

Sorry to hear this, hope you solve this with the cag. I know you signed a contract but i would have thought that they would have the decency to wait for the cheque to clear!! do you have a cheque book? if you do pay their bill by cheque and make them wait a few days longer x. I would now for devilment :rotfl::rotfl:
  • After being given the run around for a bit, I got hold of Baines and Ernst finance dept which that guy was from yesterday. I got hold of a girl who was much easier to deal with and even said that wasnt right. After some nice discussion, the agreement is I pay £200 out of my 800 cheque and then continue at £20 month until either the debt is paid or I get the £2500 back. Which Im happy with. :)

So glad I found this thread. I've been called by CAG a couple of times in the past two days. First time, I couldn't really hear what was being said except for "you could be entitled to a refund" and I was incredibly skeptical and so said I wasn't interested and hung up.

Today they rang again, and it was at lunch and I had the time to chat so I thought I'd give them a crack at it. They wanted to know information about some of the loans or credit cards I had taken out in the last 10 years. I told them that on every single one of my accounts I had said "no" to PPI. However the guy was insisting that although I had said no, a lot of these banks had still illegally taken a percentage and put it towards PPI. Sounded a bit strange to me, I thought I'd have heard about that on this website at some point, or on the news.

Anyway I continued on the chat, and went as far as to give my address so they could send me the forms. I was glad of that because I *never* agree to anything over the phone. I thought, at least I can follow through with this, then come online to see what experience all you guys have had... I'm glad I did :)

I'm not going to sign anything just because they think they can get money due to me, I don't believe anything is due to me and I definitely don't want them to start asking for money up-front, like they have mentioned on other threads about CAG.

I will read the docs when they come, but most likely throw them in the bin. And ask them to take my number off their records and stop calling me.

    Thanks!

I just received a call from CAG, and it was very amicable! The gentleman asked if I'd received my pack yet, I said "yes, but I've taken advice on the matter and have decided to go ahead with the claim by myself thanks. So if you'd be good enough to take me off your records please"... To which he replied "Absolutely no problem at all sir, may I wish you the best of luck with your claim." - "Thank you very much!"

That has to be the politest dealings I've ever had with one of these companies! :)
