Esa & dla

Have added to a thread in disability but not sure if it should be here so here goes and apologies for dupe.:o

Can anyone tell me if you can claim DLA whilst in receipt of ESA? Also if you can would this affect an existing housing benefit/ council tax credit claim and child tax credit awards?

All advice greatly appreciated.

    Yes you can claim DLA whilst claiming ESA.
    If you get DLA you will probably get extra premiums with your HB/CTB claim. It won't affect your child tax credits at all, as this relates to your children not you.

    DLA is a separate benefit from ESA and there's no reason why you can't claim both. DLA is awarded for your care and/or mobility needs and is not primarily based on the condition causing those needs.

    If I can elaborate a little more........

    OH was suddenly taken ill and ended up spending over a year in hospital and as a result of which he has been left unable to walk unaided and he can only walk short distances with walking aids, anything longer would require a wheel chair.

    Before he was ill he was a house husband, not claiming any benefits, and took care of our children whilst I worked full time. After he had been ill for about 3 months I got made redundant. I went to Job centre for an interview and the 2 ladies I spoke to said rather than me claim JSA my OH should claim ESA which he duly did and we have been in receipt of now for over a year. They dont even ask for med certs anymore but they may be due to what he had wrong with him which was particularly nasty.

    He has been left unable to drive and requires care during some of the day and night. He is unable to prepare himself a hot meal and is unable to carry a hot drink from the kitchen in to the lounge.

    What I would like to know is if he put in a claim for DLA would this upset his ESA claim? And if he was to be awarded it would he have to advise anyone re HB & CT and Child Tax Credits?

    Sorry for the long post but just wanted to make sure I got all the info across.

    CTc isn't affected - DLA isn't income and because an adult is receiving it, CTC stays how it is. You'd get a premium on CTB & HB. This means having to pay less than what you do now.

    No DLA won't upset his ESA claim.
    If he got DLA you would inform all the relevant departments that you currently get benefits from.

    I know I keep going on about it but have only found out about the possibility of getting it after reading various threads.

    Yes he can definitely claim DLA whilst in receipt of ESA.

    Previous posters are correct - your husband can claim both DLA and ESA.
    If they haven't helped put your mind at rest, have a look at:

    Effect on other benefits and entitlements

    If you start to get Disability Living Allowance it might increase the amount of other benefits or credits you're entitled to, such as:
    • Income Support
    • Income-related Employment and Support Allowance
    • Income-based Jobseeker's Allowance
    • Pension Credit
    • Housing Benefit
    • Council Tax Benefit
    • Working Tax Credit
    • Child Tax Credit
    Disability Living Allowance is normally ignored as income for working out these income-related benefits and credits.
