    The ebay and paypal claims are completely different and it is a two tier system, and whilst there is this two tier system it realy pays to only ever pay by paypal.

    so does that mean i should close the dispute and place a chargeback, also how do you place a chargeback?

    If you log into paypal you should be able to escalate your dispute into a chargeback. I had to do this recently and it does take a few minutes to see what Paypal are getting at sometimes, but read all the bits and it will tell you exactly how to proceed. If I remember correctly from the claim page I had to choose to escalate it, rather than wait on the seller to respond any further.
