item not receieved?

ok, i brought an item off ebay via paypal payment. it has been a month or so with a few emails going back and forth with the sell.

seller stating "i'm making a claim with the post office"

but that was about 2 weeks ago, does it take that long?

so i have declared a dispute with paypal, and now the reply back from the seller is "Recorded delivery was offered and not taken up. You chose 1st class and both myself and ebay express that I cannot be held responsible for lost items. I have opened a complaint with royal mail, sent the tag from your item and my proof of purchase. I am awaiting a reply from Royal Mail, I don't have to do ANY of this. Read your terms & conditions."

so does that mean if royal mail does not refund for the lost item, i am out of pocket?

    No, an ebay claim would fail but a paypal claim will suceed. Make sure you are doing a proper paypal chargeback not a dispute and stick with it. Unless the seller can prove delivery he will lose a paypal claim;

    The ebay and paypal claims are completely different and it is a two tier system, and whilst there is this two tier system it realy pays to only ever pay by paypal.

  • I think this is wrong, it happened to me, i sent an item, had proof of postage and he claims it never arrived

    Why dnt we all do that then- buy expensives items where insurance isn't offered, receive it, and claim we never got it and sell the item on

    Money for nothing isn't it

    Meanwhile me, a honest person am out of pocket coz of either the royal mail being useless or my buyer being a lyer

    It might work a couple of times but RM would catch on soon enough if repeated claims were being put through for the same address.

    By that time u made urself a grand that the sellers lost, either way- i think its the buyers fault if they dnt choose to pay for insurance- not mine

    The seller is liable for sending all items.
    If it gets lost the seller deals with RM.

    The buyer has no fault as they have not received their goods.
    Until they receive their goods that transaction has not been completed.

    The buyer doesn't need to buy insurance as the buyer cannot claim from RM.
    Insurance is for the SELLER, not the BUYER.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

    Although it might seem unfair that ebay and pp put the onus on the seller to ensure that the item is delivered, it's the only way to make it work, realistically, since it's the seller who has the contract with the shipper, be that RM or a courier.

    Although as a buyer you can moan at the shipper, it's the seller who has to deal with any claim and thus for pragmatic reasons, eb and pp deem it their responsibility.

    Laura look at it from the otherside. If you bought an item and it didn't turn up and seller said tough how would you respond?

    As moglex says it is the ONLY way it can work. There are dishonest buyers but there are also occasions when things get lost with RM some of which will be down to dishonest postmen.
