Am I entitle to disability benefits

I have been suffering with back problems, resulting in me having trouble walking and doing general tasks.
Due to having to damage disk in my lower back.

Can I claim benefits for this?

  • Yes, I am , but I have been off sick due to my back for 5 weeks. but I will return soon, as I am getting presured by manager.

    If you're unable to work due to illness and do not get Statutory Sick Pay then you are eligible to apply for Employment Support Allowance.

    If you have care and/or mobility problems, have had the problems for three months and are expected to have them for at least a further six months you are entitled to apply for Disability Living Allowance. You can claim DLA regardless of whether you are working or not providing you continue to have care/mobility needs.

    Good luck getting DLA. I have three damaged discs in my lower back which are inoperable as two of them had been operated on before back in 1992. I've got this for the rest of my life and the best the specialists can offer is pain management. I had to fight to get just lowest rate mobility - I get nothing for care even though a fair bit of the time I can't stand long enough to make a sandwich. I was told, get this, that I could sit on a chair. When I pointed out the flaw in that in so much that I couldn't lift the flaming chair to move it I was just given a "not our problem" response.

    As said, apply for ESA if you have to stop working.

    I have the same problem and was advised to use a perching stool but it doesn't matter if I'm standing, sitting or perching my back goes into spasms. When you next apply for your DLA you should emphasise the fact that sitting down doesn't help. Personally I think sitting down whilst at a cooker is dangerous - what happens if you spill something hot cos you are, quite literally, a sitting target!

    Making a sandwich isn't classed as a care need.
    Personally I think sitting down whilst at a cooker is dangerous - what happens if you spill something hot cos you are, quite literally, a sitting target!

    So wheelchair users should only drink cold drinks then and never use a cooker?

    We have no choce but to sit and get on with things even though my broken, crushed and congenitally deformed spine spasms constently.

    to hammy man low rate mobility isnt given for mobility reasons but for supervision outsideand its normally given to people with MH or LDs.
    Technically if you can't make a meal from scratch it counts towards low rate care

    wrong, a sandwich isnt a meal znd you wont get low rate care for it.

    I appreciate that you have no choice in the matter and it may come to the fact, if things continue to progress as rapidly as the way they have in the last 2 years, I won't have any choice in the matter soon either!
  • i completly stand by you with the whole back issue.

    i have very much the same, prolapsed discs in my back, crushed nerves, and arthritis aslo

    i have applied for dla

    i have had this issue for few years now, docs kept saying back muscles.

    mri showed the problems. ops are needed

    i cant sleep, get dressed, cant shower or bath, get in or out of bed, in or out of chair or make a drink with out some support or help as my legs give way due to the sciatica in my legs.

    im still waiting on my docs report to return to them, im not hopefull i will get anything as my doctor is useless and left me with this problem for years.

    i have wrote to them asking for them to speak to my consultant and surgeon at the hospital whos is planning my operation and is fully aware of my issues

    but dla is an !!!! to get with out the full support of the medical profestion.
