  • OK...if no CCJ is registered on your credit reference files, then regardless of a summons being issued, a CCJ was not registered against you, therefore you haven't defaulted on the CCJ payment and therefore no Bailiff action can be ordered. So, that's that worry taken care of :D

As soon as you hear back from 'them" (the tracing company) you can contact the company that feel you owe them money and start to resolve the problem :D

You're doing good girl, try not to worry.

    I'm off for a cuppa now :D
  • Thanks so much enjoy your cuppa. Oooh btw I just found an email cancelling my Virgin Broadband dated 3rd November 2008 as well as requesting my account information (as we had been flooded and I lost a lot of paperwork).

They replied saying they couldn't help and to call some people, after I stated quite categorically I had no access to a telephone. I've obviously given them a call after that. But surely this would back me up in my favour?

Hey, an email dated 3rd November, cancelling your Virgin Broadband is a good find. But, you do have to actually call someone at Virgin ( I am with them) to cancel your contract, so not surprised they replied asking you to call the cancellation dept, so therefore that email may not actually prove you have cancelled your account back then because you were not able (due to no phone) call them and follow the correct cancellation procedure. They would win the argument on that technicality if it is in their terms & conditions: that you have to call to cancel your contract :(

It wouldn't honestly surprise me with virgin if they've slapped cancellation fees on your account (assuming you ended your contract early), as when I ended my telephone / broadband contract early they stuck £200 cancellation charges on there for the trouble!
  • Mmm sounds about right. Also that trace and search came back. Council tax quelle surprise!

  • Bit of an update... the woman I spoke to emailed me back saying that they were acting on behalf of Liberata (Southwark council) but the thing is the searches that were done are coming up as AFTER they contacted me by post).

I emailed her back saying thank you for letting me know, I am currently in contact with them and discussing what we can do. Would there be anyway to remove these searches as four is extremely excessive for the two days (three on one and one on another). She said that she would only be able to remove the searches once Liberata sent them the permission.

The thing is I haven't heard from the council tax people for ages...I've been in contact with them and they keep telling me to hold on and they will deal with my enquiries. It's terribly frustrating as I want to see where I stand with this. Also the council have demanded my exemption letters for the time I was a student despite them already having this on file.

Any suggestions what I can do? Or should I just wait?

  • Hi

Just wait. You have made contact with the council and no doubt they are looking into your inquiry.

If they already have a copy of your student exempt letter on file, as them for a copy of this. You may have to pay to get them to release this to you.

The searches will probably not be removed, even though she said they could remove them if the council give them permission. They were legitimate searches made to locate you, so in reality there are no grounds to remove them. Its highly unlikely the council will consent to this, unless they find that you are not in fact responsible for the monies they say you owe.

Let them conclude their investigations and if they decide you don't owe them money, at that stage you can demand they remove the entries on your credit files.

So basically, my advice is to sit tight, let them do their stuff and wait to hear from them.
  • Cool. I'll just sit tight then. It just worries me because the people who I've spoken to at the council have been really unhelpful. I've emailed my university to get them to send me a new exemption letter just in case.

Because I've provided them with details of who I used to live with will they contact them?

  • The council will be unhelpful, you are fighting your corner and demanding they investigate a claim for monies owed that you are denying, it cost them time and trouble :D enjoy annoying them, they deserve it if they are unfairly charging you monies you do not owe.

The new exemption letter is a very good idea, when you get it, photocopy it so that you have two copies :D

Yes, they probably will contact them, nothing you can do about that.

It sounds to me like you have the situation now under control and hopefully it will all be resolved very soon :T :T
    Have a nice day :D
