You should have worded your contracts correctly...5.6 weeks hol, no recognition of bank hols.

they havent had any written contracts yet.... but i have told them 28 days which include bank holidays...

If you state they are entitled to 28 days which includes bank holidays you are fine surely. You are specifying that they must take a day off holiday on BH's so next year they would take the 9 BH's and have 19 left to take when they like. 5.6 weeks is much easier to have in your contracts and then specify that BH is a normal working day.
Luckily I worded our contracts correctly if we didnt it would cost £42,000.00 for the one day extra!0 -

I am sure you probably already know but I would definately get your contracts written out because as soon as someone takes you to a tribunal over anything they can add the lack of written contracts as an extra and get 4 weeks wages as compensation.The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
