Ebay advice please

Been a long time lurker on the boards and just wanted some advice. I won a pair of tracksuit bottoms descibed as very good condition. When opened looked at them and they were stained and had gloss marks down them. Politely asked for a refund, seller emailed back saying that it was her fault that she disn't check the item before sending and also if I wanted a reciept that I had to send back the item, so I would be out of pocket for something so small. I just wanted to know where I stand really.
My apologies for the essay I have just never had that many problems on ebay.

    Ask her politely for your return postage to be reimbursed.

    Realistically, you should usually return items to get refunds, and eBay or Paypal, when asked to enforce a refund, demand the item is sent back, and have no facilities set up (at the moment at least) to reimburse return postage. A good seller - and it sounds like your seller is being co-operative - should reimburse postage but they can't be forced to. Also, eBay and Paypal will both insist that you return the item tracked (i.e. on a low cost item recorded delivery) to prove it has been delivered or that delivery to the seller has been attempted. It might be wise if you are returning it to send it tracked, thereby preventing the seller reneging on the deal (as if she doesn't uphold her end of the deal you can go straight to eBay or Paypal).

  • I will send it the cheapest recorded delivery and get all the proof of posting I need so that way if it does backfire then I can take further action via Paypal or Ebay.

    Thank you for the advice, I was thinking along the same lines and just needed some clarification :).
    Hold onto the recorded slip as you need proof of delivery to get a dispute to go in your favour.

  • I have filed the dipute with Paypal and I have won but I can only get a refund if I send the item back recorded delivery before 23/12 and put in the tracking number. The thing is I have already sent back the item recorded delivery and the seller claims they never recieved the item. I have no idea what to do next.

    If you've sent it back recorded then you will have a tracking number - when you input the number to track it - you will get a copy of the delivery note and it will show a signature/date of delivery - so no problem.

    Check the tracking number - if it is showing as delivered it should be an open and shut case to get your money back.

    If not then you might have more problems.

  • I wasn't given the tracking number, the only thing I was given was 2 reciepts 1 stating I had paid the postage and 2nd stating the postcode, where the item was due to be delivered to.

    The tracking number will be on the receipt if it was sent recorded. It will be just above the address it was sent to, and will say something similar to this:

    PLEASE can anybody help me. I desperately need advice.

    I sold an item on ebay about 5 weeks ago. It was brand new tuxedo suit, in pristine condition and it sold for £442. About three weeks ago I received notification that the buyer had reported the item to paypal as ‘not as described’. The buyer claimed the suit was used and worn and I had sold it in poor condition. This is a complete lie. I have over 1000 feedbacks and a 100% rate. I would never, ever defraud a customer and pride myself on the quality of the items I list. I explained to paypal that this was clearly a case of fraud. Nevertheless, my account was restricted by paypal while the suit was returned. It came back the other day in a terrible state. The buyer has altered it, worn it, and damaged it beyond resale. There was even make-up on the zipper of the trousers!!! I would never, ever have sold it like this. Paypal found in the buyer’s favour and refunded him, completely ignoring my evidence. I appealed and they have said their decision is final. Meanwhile, they will not allow me to add funds from other sales until I clear the balance which they have applied to my account. I am out of pocket due to fraud and paypal are screwing me over again!!!

    Please, can anyone advise, is there anything I can do. I cannot afford to pay the outstanding balance except through selling my own clothes but paypal won’t let me accept payments using their site. They are refusing to take away the restriction and now ebay are doing the same (limited use of ebay site). I have done nothing wrong through all of this. I even videod the opening of the returned suit so I could provide evidence of the damage done but paypal have said they won’t accept it or the pictures of the suit I used in the sale, which clearly show it as brand new. They have completely ignored everything I have said, even though I have over 1000 feedbacks and the buyer had 13! I can’t even leave negative feedback to warn other sellers about this guy....

    Advice very much appreciated...
    For that sort of thing, you may have legal recourse against the buyer.
